U.S. affiliates of at least nine Japanese companies, including Toyota Tsusho Corp. and Sumitomo Chemical Co., have filed a lawsuit against the U.S. government seeking full reimbursement of additional tariffs they would have paid this year if the Supreme Court rules the duties illegal.
According to the latest court filings, these companies argue that the Trump administration's imposition of reciprocal tariffs through the use of the International Emergency Economic Powers Act (IEEPA) without congressional approval is illegal.
The companies’ complaint was filed in the U.S. Court of International Trade in New York after the Supreme Court held oral arguments on November 5, during which the justices expressed skepticism about Mr. Trump’s authority to bypass Congress to impose double-digit tariffs on imports from most countries.
These member companies decided to take legal action due to concerns that refunds to importers would not be guaranteed even if the Supreme Court rejected the US government's reciprocal tariffs.
Lower courts have previously ruled that Mr. Trump exceeded his presidential powers by invoking IEEPA to implement reciprocal tariffs and impose new duties on goods from China, Canada, and Mexico related to the flow of fentanyl into the United States.
While it is unclear when the Supreme Court will rule on the issue, dozens of other companies, including U.S. warehouse retailer Costco Wholesale Corp., have also sued the administration over the legality of the new global tariffs, seeking refunds if the court declares the measures invalid.
