Beware of “vacation ownership contracts”

Lam Dong Department of Culture, Sports and Tourism has just sent an official dispatch to localities and tourist establishments regarding the business of "vacation ownership contracts", in order to protect the rights of people and tourists, and prevent risks when signing this type of contract.

Lam Dong Department of Culture , Sports and Tourism has requested localities to step up propaganda to alert people to the risk of being exploited and scammed in "vacation ownership contracts" activities; at the same time, review and make a list of establishments and businesses operating in this type of business and report to the department.

Lieutenant Colonel Pham Thanh Hung, Deputy Director of Lam Dong Provincial Police, said: Recently, many businesses have come to the area to organize conferences and seminars to sell "vacation ownership contracts" - a form of pre-purchase of vacation rights at hotels or resorts. This activity is becoming more and more popular and appears under many other names such as "vacation contracts", "family vacation contracts" or " tourist cards".

According to the Department of Culture, Sports and Tourism, it has notified localities and businesses to propagate for tourists to raise their vigilance with "vacation ownership contracts".

The “vacation ownership contract” activity is becoming more complicated, as some businesses take advantage of legal loopholes and customers’ lack of knowledge to defraud and sign contracts that are unfavorable to buyers.

The country has recorded many disputes and lawsuits related to "vacation ownership contracts", but authorities find it difficult to handle them because this is a voluntary civil transaction and there are no specific management regulations.

Lam Dong Department of Culture, Sports and Tourism requires businesses providing “vacation ownership” services to publicly and transparently disclose information and contracts, and not include clauses that disadvantage customers. At the same time, tourism establishments need to monitor the activities of units hiring to organize conferences and seminars and immediately report to the authorities when detecting signs of suspicion or fraud.

Timeshare is a tourism model that provides pre-purchase of vacation rights at one or several hotels or resorts for a certain period of time seasonally or continuously for many years depending on the agreement signed between the parties.
