National Assembly Chairman Tran Thanh Man: Any investor coming to our country asks if there is enough electricity?

Noting that any investor coming to our country raises the issue of whether there is enough electricity for production, National Assembly Chairman Tran Thanh Man pointed out that to have enough electricity, there must be mechanisms and policies for development. The National Assembly's Resolution on mechanisms and policies for national energy development is not to remove difficulties but to look to the future to have synchronous solutions according to Resolution 70 of the Politburo.

Continuing the 10th Session, this afternoon, December 4, the National Assembly discussed in Groups: the draft Law on Specialized Courts at the International Financial Center and the draft Resolution of the National Assembly on the mechanism and policy for national energy development in the period 2026 - 2030. National Assembly Chairman Tran Thanh Man participated in the discussion in Group 11 including the National Assembly Delegation of Can Tho city and Dien Bien province.

If there is any negativity or policy abuse, the Government and the Ministry of Industry and Trade must take responsibility.

Regarding the draft Resolution of the National Assembly on the mechanism and policy for national energy development, delegates basically agreed on the necessity of issuing this Resolution because the demand for electricity for national development, especially in the context that we set a target of continuous double-digit growth for many years to come and the orientation of developing national data centers, digital technology , artificial intelligence... is extremely large.

National Assembly Chairman Tran Thanh Man stated that recently, the Politburo issued Resolution No. 70 - NQ/TW on ensuring national energy security until 2030, with a vision to 2045. It can be said that currently, energy is the most important requirement for our country in attracting investors, developing the socio-economy, and ensuring national defense and security.

It is said that any investor coming to our country raises the issue of whether there is enough electricity for production. The National Assembly Chairman pointed out that to have enough electricity, there must be mechanisms and development policies. Recently, the National Assembly decided to restart the construction of nuclear power plants; hydroelectric, solar, wind power projects... have also been developed but have not met the requirements of industrialization and modernization of the country.

Therefore, after the Politburo issued Resolution 70, the Government submitted to the National Assembly a Resolution on mechanisms and policies for national energy development, stipulating principles, policies, and specific and outstanding mechanisms for national energy development.

The National Assembly Chairman also noted that this Resolution is not to remove difficulties but to look to the future to have synchronous solutions according to Resolution 70. "When this Resolution is issued, we also have Regulation 178. If negative problems or policy exploitation occur, the direct executive agency, the Government and the Ministry of Industry and Trade, must take responsibility," the National Assembly Chairman emphasized.

Ensuring overall efficiency and harmonizing interests

Chapters II and III of the draft Resolution are designed to shorten the investment and construction process of power projects to meet sudden and urgent requirements. However, National Assembly Deputy Nguyen Tuan Anh (Can Tho) noted that the draft Resolution has not clearly defined the principles and criteria for determining "sudden and urgent", and has not clarified the scope and conditions of application, leading to the risk of major risks arising in implementation, which can be exploited to legitimize arbitrary adjustments, over-expand authority or apply to the wrong subjects. This poses risks of transparency, abuse of power and group interests, resulting in waste of state resources, affecting socio-economic development as well as people's lives.

Analyzing specific regulations, delegate Nguyen Tuan Anh also proposed clarifying the basis and principles for planning adjustment. Accordingly, the mechanism of exemption from planning adjustment procedures should only be applied in cases of real emergency and force majeure (as stipulated in Article 14 of the Electricity Law), while clearly defining the responsibility for reporting and explaining to the Government and reporting to the National Assembly to ensure control of power and limit the risk of abuse.

Along with that, delegates proposed to add quantitative criteria for each adjustment basis, such as load increase level, adjusted capacity scale, impact scope, system operating conditions, etc. to ensure transparency and controllability. Regulations require power system impact assessment and independent consultation when making planning adjustments.

Emphasizing the need to issue a Resolution of the National Assembly, National Assembly Deputy Le Minh Nam (Can Tho) also noted that when selecting special power projects, it is necessary to carefully evaluate the costs and comprehensive, long-term benefits to ensure overall efficiency and harmonize the interests of the people, investors, businesses and the State.

Must follow international practice

Regarding the draft Law on Specialized Courts at the International Financial Center, basically agreeing with the draft Law and the Review Report of the Committee on Law and Justice, National Assembly Deputy Nguyen Van Quan (Can Tho) also highly appreciated the procedures stipulated in the draft law as modern, superior and consistent with international practices.

However, the delegate still had concerns about the provisions in Clause 2, Article 9 allowing judges of the Specialized Court to be foreigners, including how to manage foreign judges because judges are a special profession, in the name of the Socialist Republic of Vietnam to pronounce judgments. Suppose the judgment is incorrect, inaccurate, not in accordance with common law, not in accordance with precedent, what rights and obligations arise after the judgment is pronounced? The delegate suggested that this issue should be explained more clearly.

National Assembly Chairman Tran Thanh Man stated that when we decided to establish an international financial center, "the rules of the game must be international." If we do not do it strongly, investors will not come, capital will not be attracted, and if investment is not attracted, the establishment of the center will not be effective. Therefore, the mechanisms for this center must be outstanding, including the specialized court mechanism. This court is still under the guidance of the Supreme People's Court, but its operations must follow international practices.
