Clearing bottlenecks, creating special mechanisms to implement important projects in the capital

The National Assembly Chairman noted the need to pay attention to important national projects that have far-reaching impacts on the socio-economy and environment, not only in the capital but also in the entire region.

On the afternoon of December 4, continuing the 52nd session, the National Assembly Standing Committee gave opinions on the draft Resolution on piloting a number of specific mechanisms and policies to implement large and important projects in the capital.

According to the Government's Submission, on the practical basis of the draft Resolution, Hanoi is the Capital, the political -economic-cultural center, and at the same time a special-class urban area with the role of one of the two economic locomotives of the whole country.

The city is implementing a large number of key projects, including public investment projects, public-private partnership (PPP) investment projects, projects to attract strategic investors, and urban renovation and reconstruction projects of old apartment buildings.

The implementation of the above-mentioned large-scale, key projects, especially the extremely large-scale projects to be implemented in the coming time, will encounter many difficulties and obstacles, hindering the maximization of the role and position of the Capital, especially in the context of double-digit growth in the period 2026-2030.

Institutionalizing Resolution 15-NQ/TW of the Politburo, on June 28, 2024, the National Assembly issued the Capital Law No. 39/2024/QH15. This is the legal basis and an important tool for Hanoi to continue to affirm its central position. However, in reality, the Capital Law has not completely resolved the overlap and lack of decentralization in investment management.

The issuance of the National Assembly Resolution allowing Hanoi to pilot a number of specific mechanisms and policies to implement large and important projects in the capital is necessary and urgent in order to clear legal bottlenecks, attract investment, create breakthroughs, develop faster, more sustainably, and have greater spillover effects in the economic development of the Red River Delta and the whole country. The Resolution will create a solid foundation to achieve an average economic growth rate of 11% per year or more, while also meeting the requirements of innovation in management thinking, strengthening decentralization and delegation of power to the capital.

The review report presented by the Chairman of the National Assembly's Economic and Financial Committee, Phan Van Mai, stated that the Standing Committee of the Committee agreed with the necessity, political basis and practical basis of developing and promulgating the Resolution according to the shortened procedures and order, in order to institutionalize the Politburo's policy, contributing to removing institutional bottlenecks, mobilizing resources, promoting the rapid, sustainable, modern development of the Capital, with regional and national radiative effects.

However, after review, some provisions in the draft Resolution are not within the National Assembly's regulatory authority, such as selecting investors and contractors (Clause 1, Article 5), allowing the implementation of urban renovation, refurbishment, reconstruction projects or rebuilding apartment buildings under the type of build-transfer (BT) contract (Clause 5, Article 10)...

The Standing Committee of the Economic and Financial Committee proposed to review and revise, not to re-prescribe the contents that have been stipulated in current laws and resolutions, to ensure consistency and to only retain truly specific and necessary mechanisms and policies; to continue reviewing, ensuring that only specific contents within the authority of the National Assembly are stipulated in the draft Resolution.

Giving his opinion at the meeting on the draft's consistency with the legal system, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung said that this is a pilot Resolution so of course there will be provisions that are different from other laws, and it is impossible to ensure "consistency" in the usual sense.

"However, we must continue to review to see which mechanisms and policies have been prescribed and are still suitable in the context of implementing large projects. We will still implement them according to the Capital Law, not re-prescribe them here to avoid duplication. New policies that are superior to those prescribed in the Capital Law must also be assessed for their necessity and feasibility," Mr. Hoang Thanh Tung emphasized.

In addition, many contents in the draft Resolution are related to the provisions of other laws and resolutions being submitted to the National Assembly at the 10th Session. Therefore, the scope of regulation of the draft should only be issues that really need to be regulated specifically for Hanoi, while general issues that can be applied to the whole country can be included in other laws and resolutions.

Expressing his agreement with the issuance of the Resolution, National Assembly Chairman Tran Thanh Man emphasized that the Resolution aims to remove obstacles, mobilize and effectively use resources to promote the rapid, sustainable, modern development of the Capital, with spillover effects, leading the region and the whole country, promoting double-digit economic growth in the 2026-2030 period; realizing the vision of developing the Capital by 2045.


Regarding consistency, the National Assembly Chairman also requested: "We should eliminate any content that is already in current laws and laws decided at the 10th Session, and focus on truly outstanding mechanisms and policies that are effective in removing bottlenecks, avoiding arbitrary expansion or spreading regulations."

Regarding the scope of the draft Resolution, National Assembly Chairman Tran Thanh Man stated that it is necessary to clearly identify the focus and key points, avoiding overlap between project groups. Regarding the authority to decide on investment policy approval, the National Assembly Chairman noted that it is necessary to pay attention to important national projects that have a profound impact on the socio-economy and environment not only in the capital but also in the whole region; reduce and simplify administrative procedures to ensure flexibility and timeliness, so that the city can speed up the progress of urgent and key projects.

"The selection of investors and contractors must ensure fairness and transparency. Pay attention to how to implement the post-audit mechanism when allowing simultaneous implementation of procedures; limit the risk of breaking the general planning, not ensuring design requirements and necessary technical conditions, and causing disputes affecting the progress and quality of the project..." - said the National Assembly Chairman.

Concluding the discussion, Vice Chairman of the National Assembly Vu Hong Thanh said that the National Assembly Standing Committee basically approved the contents of the draft Resolution, which is eligible to be added to the 2025 legislative program for the National Assembly to consider and approve according to the shortened procedures at the 10th Session.

The National Assembly Standing Committee proposed that the Government continue to direct research to complete the draft, focusing on a number of key contents such as: Reviewing and supplementing documents to ensure full legal basis for specific mechanisms and policies; clearly reporting the relationship, differences and ensuring consistency, avoiding overlaps and duplications between the draft Resolution and the mechanisms and policies in the Law on the Capital, related draft laws and resolutions being submitted to the National Assembly for consideration at the 10th Session, especially laws and resolutions related to planning, urban and rural planning, investment, bidding, finance, land, and investment in the form of public-private partnerships.

At the same time, the Government will coordinate with the Standing Committee of the Economic and Financial Committee and the agencies of the National Assembly to carefully review the draft, ensuring that the specific regulations are truly breakthrough, focused, and key, avoiding arbitrary expansion, spreading, and formality; ensuring constitutionality, reflecting necessary contents within the authority of the National Assembly; clarifying the feasibility of projects using mixed capital from the Capital and the central budget...


At the meeting, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly on a number of specific mechanisms and policies applicable to the high-speed railway project on the North-South axis; on explaining, accepting and revising the draft Law on Artificial Intelligence; and the draft Law on amending and supplementing a number of articles of the Law on Value Added Tax./.
