Attending the citizen reception session were representatives of the Provincial People's Council Standing Committee, the Provincial National Assembly Delegation, Party committees; leaders of departments, branches and Vinh City People's Committee, Thai Hoa Town People's Committee.
Chairman of the Provincial People's Committee Nguyen Duc Trung received citizen Le Dinh Thanh, residing in Quang Vinh block, Quang Tien ward, Thai Hoa town.
Mr. Thanh requested the competent authority to cancel the conclusions and decisions of the Provincial People's Committee and the Thai Hoa Town People's Committee on land recovery and the Land Use Rights Certificate of his family and Mr. Le Dinh Hung; at the same time, reissue the Land Use Rights Certificate to his family.
According to the content of the case, the land plot that Mr. Le Dinh Thanh and Mr. Le Dinh Hung are using in Tay Ho II block, Quang Tien ward, Thai Hoa town (formerly Tay Ho II hamlet, Nghia Quang commune, Nghia Dan district) was previously used by Nghe An Agricultural Machinery and Rural Development Joint Stock Company. In June 2004, this company completed procedures for asset liquidation and sold 2 rows of level 4 houses to Mr. Thanh and Mr. Hung.
The two households fulfilled their financial obligations and were granted land use right certificates by the Nghia Dan District People's Committee. Then, based on the report of the Interdisciplinary Inspection Team, on June 16, 2009, the Chairman of the Provincial People's Committee issued Conclusion No. 197 stating that the company's house valuation lacked transparency and democracy; the Nghia Dan District People's Committee's decision to allocate land and grant land use right certificates to Mr. Thanh and Mr. Hung's households was against the law.
The Provincial People's Committee has assigned the Thai Hoa Town People's Committee to reclaim the entire area of the two plots of land granted to Mr. Thanh and Mr. Hung; to develop a new land use plan and submit it to the competent authority for approval to put it into use according to the provisions of law. Disagreeing with the above decision, 2 citizens filed a petition.
At the citizen reception session, leaders of the Provincial Inspectorate, the Department of Natural Resources and Environment, and the People's Committee of Thai Hoa town reported, analyzed, and assessed the nature of the case; at the same time, proposed solutions in the spirit of ensuring the legitimate and legal rights and interests of citizens.
Concluding the case, Chairman of the Provincial People's Committee Nguyen Duc Trung assessed that the case of Mr. Thanh and Mr. Hung had been going on for a long time, from 2009 until now, but had not been completely resolved. During the resolution process, many issues had not been clarified, although the Provincial People's Committee had directed and assigned the interdisciplinary inspection team to review and assigned Thai Hoa town to consider and resolve the contents of the citizens' petitions.
Through actual assessment, the two families have had a stable land use period of 20 years, without any disputes. In addition, after review, it is found that Conclusion No. 197 dated June 16, 2009 of the Provincial People's Committee still has many issues that have not been addressed, in which, the most important is the lack of attention to resolving the legal and legitimate rights of citizens, because the citizens themselves are not wrong.
Emphasizing the viewpoint on resolving the case, Chairman of the Provincial People's Committee Nguyen Duc Trung requested all levels and sectors to thoroughly and comprehensively consider the case in the spirit of ensuring the legitimate rights and interests of citizens, this is the highest priority because these families are still policy families.
To thoroughly handle the case, the Chairman of the Provincial People's Committee assigned the Provincial Inspectorate to preside over and advise on the establishment of an interdisciplinary inspection team consisting of departments, branches, the Provincial Citizen Reception Committee, and the People's Committee of Thai Hoa town to conduct a comprehensive and thorough review of related contents, in which the legitimate and legal interests of citizens must be given the highest priority.
The inspection team must review Conclusion No. 197 dated June 16, 2009 of the Provincial People's Committee, review the land use process, financial obligations, planning, and related difficulties and problems. The inspection team must report the results to the Provincial People's Committee and notify the people before June 15, 2024.
Chairman of the Provincial People's Committee Nguyen Duc Trung also received citizen Hoang Van Khuong, residing in Hamlet 34, Nghi Kim Commune, Vinh City. Mr. Khuong disagreed with Conclusion No. 284 dated December 4, 2013 of the Vinh City People's Committee on the settlement of the complaint against Mr. Dang Tho Tuong - former Party Secretary, Chairman of the Nghi Kim Commune People's Committee, for taking advantage of his position to appropriate agricultural land from households in Bau Tron area, Hamlet 4, Nghi Kim Commune to dig ponds, raise fish and force households to cultivate in the fields adjacent to the city's landfill.
Reporting on the process of handling the citizen's complaint, Chairman of Vinh City People's Committee Tran Ngoc Tu said that on December 4, 2013, Conclusion No. 284 was issued on handling the citizen's complaint, concluding that the complaint was false.
Then, following the direction of the Provincial People's Committee, the Chairman of the City People's Committee continued to establish a verification team and on July 26, 2018, reported, continuing to affirm that the content of the citizen's accusation was wrong, with 4 points: Taking agricultural land in Bau Tron area of 11 households to hand over to Mr. Dang Tho Tuong's household for production and handing over agricultural land in other locations to households was to carry out land conversion according to Directive No. 02 of the Provincial Party Standing Committee.
The implementation process was made public, households were allocated agricultural land at the new location and have been producing since then until 2010. Mr. Dang Tho Tuong's family had to return more than 2,300 m2 of land in another area to allocate to other households for production.
On the other hand, the accuser could not provide documents or evidence to prove that Mr. Dang Tho Tuong took advantage of his position to appropriate agricultural land from households and forced them to receive land in other fields.
"The handling of the complaint was objective, accurate, and true to the nature of the case. All legal, procedural, orderly settlement processes and especially the rights of the households were guaranteed and satisfied," the Chairman of Vinh City People's Committee emphasized and said that, up to now, 9/11 households have received compensation and site clearance when Vinh City reclaimed land in the Bac Cong Da area to build a 36m road, and 2 other households had legitimate reasons.
Concluding the citizen reception session, Chairman of the Provincial People's Committee Nguyen Duc Trung summarized the developments of the case and the process of handling the complaint of Vinh City People's Committee, and the review results of the Provincial Inspectorate.
However, up to this point, the citizen has not been able to provide any new documents or evidence related to the content of the complaint. Therefore, the Provincial People's Reception Council does not have enough basis or grounds to continue to consider and resolve the citizen's complaint and denunciation according to regulations.
Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the Vinh City People's Committee to continue reviewing related contents. If there are any issues related to the legal and legitimate rights and interests of citizens, they will be concerned and resolved.
Vinh City People's Committee directed Nghi Kim Commune People's Committee to continue to notify households to be guided on declaration and procedures for preparing application files for issuance and exchange of agricultural land use right certificates according to regulations.
