My child is severely disabled and has a decision to receive a subsidy from the District People's Committee. I would like to ask, when my child goes to university, will he be exempted from tuition fees according to Decree No. 81/2021/ND-CP? If so, after implementing the two-level government, will the decision to receive a subsidy from the District People's Committee still have legal value to prove that my child is eligible for a university tuition exemption? On September 3, 2025, the Government issued Decree No. 238/2025/ND-CP regulating policies on tuition fees, exemption, reduction, support for tuition fees, support for learning costs and service prices in the field of education and training, replacing Decree No. 81/2021/ND-CP dated August 27, 2021 regulating the mechanism for collecting and managing tuition fees for educational institutions in the national education system and policies on tuition fee exemption, reduction, support for learning costs; service prices in the field of education and training.

Accordingly, Clause 3, Article 15 of Decree No. 238/2025/ND-CP stipulates that subjects exempted from tuition fees include: "Students in vocational education and higher education institutions who are disabled".

Clause 3, Article 18 of Decree No. 238/2025/ND-CP stipulates the procedures and order for implementing tuition exemption and reduction in public vocational and higher education institutions, in which people with disabilities, in order to enjoy the tuition exemption policy, need to submit a certificate of disability issued by the People's Committee of the commune or ward.

Thus, according to your letter, if your child is disabled, studies at a university level at a higher education institution and submits an application to the higher education institution (including a request for tuition exemption and a certificate of disability issued by the People's Committee of the commune or ward), he/she will be exempted from tuition fees according to the provisions of Clause 3, Article 15 of Decree No. 238/2025/ND-CP mentioned above.
