Da Lat proposes canceling the results of the Thuy Ta restaurant auction.

On November 24th, the People's Committee of Da Lat City announced that it had submitted a proposal to the People's Committee of Lam Dong Province to consider revoking the decision approving the auction results for the lease of the house attached to the 10-year land use right for Thuy Ta restaurant (on Xuan Huong Lake scenic area).

Previously, the Da Lat City People's Committee received a document from the Lam Dong Provincial Asset Auction Service Center regarding customer Doan Hai Ha's announcement that he would not participate in the investment in Thuy Ta restaurant. Mr. Ha's reason was that his preliminary business plan required him to change the restaurant's name from Thuy Ta to HV, meaning he would remove the name Thuy Ta and replace it with HV. Mr. Ha argued that this name change would generate significant annual revenue, not to mention advertising for other brands.

Mr. Ha wanted to change the name of the Thuy Ta restaurant but was not granted permission.

According to the Da Lat City People's Committee, Mr. Ha's proposal has no basis for implementation. This is because Thuy Ta restaurant is located in Zone I of the Xuan Huong Lake National Scenic Area (recognized in 1988). Furthermore, the urban design content for the Thuy Ta restaurant site (spatial organization orientation, beautiful views and perspectives, traffic, lighting, greenery, planning indicators, architecture, etc.) has already been stipulated in Decision 2609/QD-UBND (dated November 25, 2016) of the Provincial People's Committee; based on a document from the Ministry of Culture, Sports and Tourism (No. 1941/BVHTTDL-KHTC dated May 26, 2016) regarding the agreement on the detailed planning of Xuan Huong Park and the urban design of Xuan Huong Lake.

The change of the name of Thuy Ta restaurant (Area I of Xuan Huong Lake scenic area) must be handled and approved by the relevant ministry; the Da Lat City People's Committee does not have the authority to change this place name.

Thuy Ta Restaurant boasts one of the most prime locations in Da Lat.

According to the Da Lat City People's Committee, 15 days after the Provincial People's Committee approved the auction results, Mr. Ha still did not fulfill his obligation to pay the approved winning bid amount, and also announced that he would not invest in the Thuy Ta restaurant. Although Mr. Doan Hai Ha had won the auction and received the approved winning bid result, the winning bidder refused the result and refused to pay the winning bid amount, resulting in the loss of the deposit (over 608 million VND). Canceling the winning bid is in accordance with the 2016 Law on Auction of Assets.

In addition to requesting the cancellation of the auction results, the Da Lat City People's Committee also proposed that the Provincial People's Committee agree in principle to allow the city to continue organizing a second auction for the lease of Thuy Ta restaurant according to the procedures and regulations outlined in the approved auction plan.

Previously, Thanh Nien newspaper reported that public opinion was stirred and "shocked" when Mr. Doan Hai Ha (Bac Tu Liem District, Hanoi ) won the bid to lease Thuy Ta restaurant in Da Lat City for a staggering price of 15.15 billion VND/year (paying the rent in one lump sum for 10 years, totaling over 151 billion VND), while the starting price was only 3.04 billion VND/year.
