Proposal to soon include regulations on vehicle license plate auctions into the Law

Driver management is still inadequate.

On the morning of November 10th, Minister of Public Security To Lam, on behalf of the Government, presented the Government's submission on the draft Law on Road Traffic Order and Safety.

Listing six practical reasons for enacting the law, Minister of Public Security To Lam emphasized that while the road traffic order and safety situation has improved in recent years, it remains complex, with traffic accidents still at a high and serious level, especially in terms of fatalities, and always posing many potential risks to the safety of people and vehicles participating in traffic.

According to statistics, on average, nearly 9,000 people die and almost 30,000 are injured annually, mostly among people of working age, directly impacting socio -economic development.

"Traffic violations remain widespread, and traffic culture is still weak. Human safety in the field of road transport is not yet guaranteed," Minister To Lam emphasized.

One of the main reasons is that many regulations in the 2008 Road Traffic Law have revealed limitations and inadequacies, failing to meet the requirements of management in this field, especially in light of the development of transportation infrastructure, the rapid increase in the number of vehicles, and the situation of road traffic order and safety in Vietnam.

In reality, investing in and constructing infrastructure for road transport projects faces many difficulties regarding the legal framework. Road transport currently accounts for a large and unbalanced proportion compared to other modes of transport; driver management is inadequate; and there is a lack of a comprehensive database for managing drivers engaged in commercial transport...

The draft law dedicates 11 articles to regulating: the conditions for drivers participating in road traffic; driver's licenses; age and health of drivers participating in road traffic; driver training; driver's license examination, etc.

General To Lam stated that the draft has added several new regulations that are in line with the trends and progress of digital transformation, creating favorable conditions for the people.

Accordingly, for any of the following documents: driver's license, vehicle registration certificate, vehicle inspection certificate, or compulsory civil liability insurance certificate, if the information from these documents has already been integrated into the electronic identification account or the national identity card as prescribed, then it is not necessary to bring them along.

The draft law does not detail the categories of driver's licenses like the 2008 Road Traffic Law, but only stipulates the principles for classifying driver's licenses to ensure flexibility in case of changes to relevant international treaties to which Vietnam is a signatory.

Auctioning off car license plates is initially proving effective.

Presenting the verification report, the Chairman of the National Defense and Security Committee, Le Tan Toi, stated that some opinions suggested considering a regulation absolutely prohibiting individuals from "driving vehicles while having alcohol in their blood or breath." Other opinions agreed with this regulation, as its effectiveness has been proven in practice.

Some opinions suggest adding several prohibited acts such as: fleeing after causing a traffic accident to evade responsibility; intentionally failing to provide first aid or assistance to traffic accident victims when possible; infringing upon the life, health, and property of victims and those who cause traffic accidents…

"We request that the above opinions be studied and incorporated appropriately; further review and arrangement of prohibition regulations should be carried out to ensure consistency, logic, and avoid duplication with other regulations in the draft law or with regulations of other specialized laws," the reviewing agency requested.

Regarding road transport vehicles, some opinions suggest reconsidering the regulation that motor vehicles and specialized vehicles participating in traffic must meet the conditions of "having a vehicle tracking device; a device for collecting data and images of the driver, and data and images ensuring safe journeys as prescribed," arguing that applying this to all types of motor vehicles is too broad and difficult to ensure feasibility.

According to Mr. Le Tan Toi, some opinions suggest that, after the National Assembly issued a resolution on piloting the auction of car license plates, although the pilot period has not been long, it has initially proven the effectiveness and feasibility of this new policy. Therefore, it is proposed that it be included in the draft law soon to ensure compliance with the provisions of the Constitution.

Other opinions suggest that a sufficient pilot period should be implemented to provide a complete basis for evaluation, summarization, and reporting, and to propose to the National Assembly improvements to the law at the first session of 2026.

The National Defense and Security Committee requests that the Government promptly report to the National Assembly on the results of implementing Resolution No. 73 dated November 15, 2022, of the National Assembly, so that National Assembly deputies have a basis for consideration and decision.

Regarding driver's license examinations, Mr. Le Tan Toi stated that many opinions suggested adding regulations on state management after driver's license examinations; and also adding regulations on unscheduled inspections of training, examination, and re-examination of examination results and driver's license issuance to ensure strict control .
