The Ministry of National Defense has just submitted to the Ministry of Justice a draft Law on People's Air Defense, which details the management of the use of unmanned aerial vehicles (Drones).

The draft law consists of 55 articles, of which the keyword "drones" is mentioned 86 times.

Want to fly a flycam must have a certificate, register in advance

The draft law stipulates that users of drones and ultralight aircraft must register in advance with the competent authority.

The list of prohibited acts in the bill includes "Illegal use of drones and ultralight aircraft" and "Taking advantage of or abusing the use of drones and ultralight aircraft to violate national security, aviation safety, social order and safety, and people's lives, health, and property."

The person directly controlling the drone or ultralight aircraft must be 18 years of age or older; must be trained in aviation knowledge and be granted a certificate according to Government regulations; during the process of operating and using the drone or ultralight aircraft, prohibited substances must not be used according to the provisions of law.

The Ministry of National Defense will be the licensing authority for flights of unmanned aircraft and ultralight aircraft.

In case of granting flight permits for flight activities in prohibited or restricted flight areas at airports, airfields and other areas that affect flight activities of civil and military aircraft, the agreement of the Ministry of Transport and the Ministry of National Defense must be obtained;

The bill also notes that recreational drones with a maximum take-off weight of less than 0.25 kg operating outside no-fly zones and restricted flight zones are exempt from flight licensing.

Give more power to regulators

The bill also empowers authorities to suspend flights, detain, arrest, and suppress unmanned aircraft and ultralight aircraft.

For example, flight operations will be suspended if the flight time, altitude, distance, or area are not in accordance with the flight permit; the flying vehicle has not been registered or licensed; the flight permit has expired; the flight has not been notified to the Regional Flight Control Center before the flight; the flight coordination regulations with local military agencies are not implemented...

Drones will be arrested and restrained if they fly without a license or permit; fly into prohibited or restricted areas; violate airports or surrounding areas; fly to propagate or sabotage the Party and State and commit illegal acts...; or carry flammable substances, explosives, explosives, weapons...

In Article 11, which stipulates the forces performing the task of people's air defense, the Ministry of National Defense has added a force called "the team to suppress unmanned aircraft and ultralight aircraft". This team is organized at the district and provincial levels from the district level up.

The head of the team controlling unmanned aircraft and ultralight aircraft has the right to order the control and temporary detention when detecting aircraft violating regulations.

Model aircraft are also used in agriculture for sowing seeds and spraying pesticides; and as training models for air defense forces.

In the past 10 years, the type of drones with cameras (flycam) has flourished with increasingly cheap prices. Flycam is used for journalism, filmmaking, tourism promotion...

In general, drones on the market are designed for civilian purposes. However, when falling into the wrong hands, they can become a means of espionage, collecting military secrets or even a means of dropping explosives, incendiaries, leaflets...

Explanation of terms in the draft law:

"Unmanned aircraft" is an aircraft whose control and maintenance of flight operations do not require the direct control of a pilot or flight crew on that aircraft.

"Ultralight aircraft", including:

- Flycam is a flying vehicle with a camera that is remotely controlled to take photos and record videos from above.

- Airship is a flying device whose lift is created by the gas contained in its envelope, including piloted and unpiloted airships;

- Flying models include gliders that are modeled after the shape and style of aircraft, equipped with engines, controlled by radio or pre-programmed programs; parachutes and kites with or without pilots, except for folk kites.
