Proposal for the Prime Minister to be recommended for a vote of confidence in poorly performing ministers

(Dan Tri) - Believing that it is necessary to clarify the Prime Minister's control mechanism for ministers who do not fulfill their duties, National Assembly member Thach Phuoc Binh proposed that the Prime Minister be allowed to propose to the National Assembly to vote of confidence in these cases.

This issue was raised by National Assembly representative Thach Phuoc Binh ( Tra Vinh ) during the plenary session on the morning of February 14th, regarding the draft revised Law on Government Organization.

Commenting on regulations regarding decentralization and delegation of power, Mr. Binh suggested that there should be a clear boundary between these concepts, avoiding a situation where the Government interferes too deeply in the affairs of localities, thus reducing the initiative of local governments.

He suggested that "decentralization" means that local authorities have the right to make independent decisions in a number of areas such as local economic and social development. "Decentralization" means that local authorities are assigned to perform a number of tasks according to Government regulations, but are still subject to supervision.

The delegate also requested clarification on the Prime Minister's oversight mechanism over ministers in cases where ministers perform their duties ineffectively.

Pointing out that there are many cases where ministers are criticized for not completing their tasks but the handling of responsibilities is not clear, Mr. Binh proposed adding a mechanism for the Prime Minister to supervise ministers. Specifically, the Prime Minister has the right to propose to the National Assembly to vote for confidence if a minister fails to complete his/her tasks, or to take measures to rectify the activities of that ministry.

Also concerned about regulations on decentralization, delegate Tran Quoc Tuan (Tra Vinh) said that this is a new way of thinking that has been codified into law and is urgently needed by many localities to unleash resources that are being held back by bottlenecks in the mechanism.

Mr. Tuan proposed to add to the law the responsibility of ministers and heads of ministerial-level agencies as members of the Government, submitting to competent authorities for consideration and decision on decentralization to localities when there are sufficient conditions and necessary capacity, and at the same time, it is necessary to add regulations to closely monitor this content.

"Only then will decentralization be truly effective, bottlenecks be removed, and resources be best unleashed to serve the socio-economic development of the country," Mr. Tuan said.

The delegate requested that the Government direct ministries and agencies to promptly issue legal documents to guide the implementation of the laws passed at this session.

In particular, according to Mr. Tuan, it is essential to issue a decree regulating "decentralization and delegation of power" in a clear, transparent, and rigorous manner so that the entities decentralizing and delegating power, as well as the entities receiving power, can easily implement it smoothly and effectively.

"If we delay issuing the guiding documents for the implementation of the law, we will not achieve the goals set by the Central Party Committee, which is to put the newly reorganized apparatus into operation to serve the goal of 8.0% GDP growth in 2025 and double-digit growth from 2026," Mr. Tuan added.

Agreeing with the provision in the draft law that "the Prime Minister does not decide on matters and tasks of ministers and heads of ministerial-level agencies," Representative Le Xuan Than (Khanh Hoa) argued that this is consistent with the role and authority of the national administration.

"Decree 137/2020 still assigns the Prime Minister the authority to decide on fireworks displays at festivals. This means that even very minor tasks and matters are still assigned to the Prime Minister. As a result, the Prime Minister no longer has time to do the work of governing the nation," Mr. Than stated.

The draft Law on Government Organization (amended) consists of 5 chapters and 32 articles (compared to the current Law, it has 2 fewer chapters and 18 fewer articles), and is expected to be considered and approved by the National Assembly at this session.
