Establishment of Ho Chi Minh City Civil Judgment Enforcement

The Ho Chi Minh City Civil Judgment Enforcement Agency has just announced a change in the agency's name and organizational structure. This announcement is based on Decision No. 1898 of the Minister of Justice regulating the functions, tasks, powers and organizational structure of the Civil Judgment Enforcement Agency and Decision No. 1900 of the Minister of Justice on the establishment of the Ho Chi Minh City Civil Judgment Enforcement Agency.

Jurisdiction of THADS HCMC

Organize the enforcement of cases that were being enforced by the City's Civil Judgment Enforcement Department before the merger.

First-instance judgments and decisions with legal effect; appellate judgments and decisions, final judgments and retrial decisions on first-instance judgments and decisions of the People's Court of Ho Chi Minh City.

Judgments and decisions of foreign courts and foreign arbitration decisions are recognized and enforced by courts in Vietnam.

Judgments and decisions are assigned to regional THADS Offices where the litigants or those with assets abroad or who need judicial authorization for THA.

Judgments and decisions of commercial arbitration; decisions on handling competition cases... and other cases as assigned by the Head of the HCM City Commercial Arbitration Agency.

Authority of the Regional THADS Office

Organize the enforcement of cases that were being enforced by the THADS Sub-departments in the region before the merger.

First-instance judgments and decisions with legal effect of the regional People's Court; appellate judgments and decisions, final judgments and decisions on retrial of judgments and decisions of the People's Court in that region;

Judgments and decisions are delegated by the provincial or municipal enforcement agency or the military region enforcement agency.

Decision to recognize the successful mediation results at the regional court; Decision to apply measures to redirect compensation for damages by the Investigation Agency, People's Procuracy, People's Court according to the provisions of the Law on Juvenile Justice... and other cases as assigned.

While waiting for the completion of administrative procedures related to the new working location, the regional THADS Offices under the HCM City THADS continue to perform their duties at the addresses of the (old) THADS Sub-Offices as before, until further notice.
