(Dan Tri Newspaper) - According to the new regulations of Dak Lak province, the minimum area for land subdivision is 60m2 for residential land in communes and 40m2 for residential land in wards and towns.
On October 26th, the People's Committee of Dak Lak province officially issued a new decision regarding the land use right limits for certain types of land, land use right certificates issued before October 15th, 1993, along with the conditions and minimum area requirements for land subdivision and consolidation in the province.
According to the new regulations, land subdivision must meet the following conditions: the subdivided plot must have at least one side adjacent to a road or canal with banks that also serve as a road; it must not be subject to land expropriation; and it must conform to the approved detailed construction plan.
For residential land, the minimum area for subdivision in communes is 60m2, with a minimum frontage of 4m and a minimum depth of 6m. In wards and towns, the minimum area is 40m2, with a minimum frontage of 3m and a minimum depth of 4m.
The regulations also state that the minimum area does not include land within the protection corridor, protected area, or safety zone of the project. For commercial, service, and non- agricultural production land, subdivision is only permitted when the investment project is divided or separated according to legal regulations.
For agricultural land, the minimum area after subdivision is 3,000m2 for forest land and 1,000m2 for other types of agricultural land in communes, and 500m2 in wards and towns.
Regarding land consolidation, adjacent land parcels that meet the conditions of the 2024 Land Law will be permitted to be consolidated. If the land parcels have different land use terms, the user may choose the shortest term without adjusting the land use term.
