Over the years, the Provincial Party Committee, the Provincial People's Committee, and all levels, sectors, and localities have paid attention to directing the implementation of construction order management, gradually bringing this work into order; many projects and works have been invested in and constructed in accordance with regulations, contributing to the socio -economic development of the province; the percentage of violating constructions out of the total number of inspected constructions in 2023 decreased compared to 2022 from 4.08% to 2.65%.

Bringing construction order management into order The Dong Phat Southeast Urban Residential Area Project (MB 584), Quang Thanh Ward ( Thanh Hoa City), is currently being constructed by residents according to the plan.

Firm action will be taken against violations.

Over the years, Bim Son town has been developing rapidly, with a fast-growing urbanization rate. This has led to a surge in construction demand, resulting in some projects and constructions violating regulations on construction order. To improve the effectiveness of state management of construction order, from 2021 to the present, the People's Committee of Bim Son town has issued 12 documents, directing specialized departments and the People's Committees of wards and communes to strictly implement the regulations of the Construction Law, the Urban Planning Law, and guiding documents on construction permits, construction management according to issued permits, and management of the implementation of approved urban planning...

In addition to issuing directives, the town has intensified its propaganda efforts to raise public awareness of construction regulations; assigned the urban management department to maintain a register to receive notification of commencement of construction for projects under its jurisdiction; and directed the town's urban regulations inspection team to set up mailboxes in communes and wards to receive information on violations of construction regulations from the public. Furthermore, the town has strengthened post-licensing inspections of construction regulations; in the period 2021-2024, the town inspected, detected, and handled 12 cases of violations, including 3 cases of unlicensed construction, 8 cases of construction deviating from permits, and 1 case where a residential area project allowed residents to build houses that did not conform to the planning. Administrative fines totaling 595,000,000 VND were imposed.

Similar to Bim Son town, from 2021 to March 2023, in the field of planning and land use management, the Thanh Hoa City Construction Inspection Center issued 138 administrative violation penalty decisions, imposing fines totaling 5,556,500,000 VND. These included 60 cases of land use for improper purposes, 11 cases of land encroachment, 10 cases of construction not conforming to approved planning, 3 cases of construction not conforming to approved designs, 10 cases of construction violating the content of issued permits, 19 cases of construction without permits, and 9 cases of construction violating permits or not conforming to approved designs and assessments. In addition, the Thanh Hoa City People's Committee also issued 13 decisions requiring remedial measures and 11 decisions enforcing remedial measures.

Minimize violations as much as possible.

Thanks to the resolute handling of construction violations by local authorities, the management of construction, planning, and land use in the province has gradually been carried out in accordance with regulations over the years. Violations such as unauthorized and illegal construction have been significantly reduced. According to the Department of Construction, in 2023, the percentage of violating constructions out of the total number of inspected constructions decreased from 4.08% to 2.65% compared to 2022. In 2023 alone, local authorities inspected 4,229 constructions (compared to 4,061 in 2022), detecting 126 violations (compared to 195 in 2022), and issuing 115 administrative penalty decisions totaling VND 5,428,551,000.

Bringing construction order management into order The investor of the housing and green park project in the South Thanh Hoa City urban area (phase 2) is constantly urging residents to build their houses according to the prescribed design.

In particular, several localities have actively carried out inspection and enforcement work, including: Thanh Hoa City inspected 1,323 constructions, penalized 32 cases, and imposed administrative fines totaling VND 1,338,750,000; Sam Son City inspected 689 constructions, penalized 4 cases, and imposed administrative fines totaling VND 300,000,000; Nghi Son town inspected 1,091 constructions, penalized 35 cases, and imposed administrative fines totaling VND 1,426,801,000; Bim Son town inspected 82 constructions, penalized 3 cases, and imposed administrative fines totaling VND 390,000,000; The urban regulations inspection teams of Thanh Hoa City, Sam Son City, Bim Son town, and Nghi Son town regularly organize inspections and perform their function of controlling construction order in the areas under their management. The People's Committees of the districts have directed the Economic and Infrastructure Departments and the People's Committees of the communes to strengthen management, inspection, detection, and handling of violations of construction regulations. In particular, some districts have shown positive progress in managing construction regulations, such as Cam Thuy district, which inspected 50 construction projects; and Dong Son district, which inspected 163 construction projects, penalized 5 cases, and imposed administrative fines totaling 320,000,000 VND.

However, according to the Department of Construction's assessment, construction management in some localities still has limitations; inspections are not frequent or continuous; unauthorized construction, construction deviating from approved designs, and construction in violation of approved plans still occur in some places and sectors, especially the construction of individual houses on urban planning areas that do not comply with approved detailed plans and urban designs; in some places, violations are detected during inspections but no thorough measures are taken to address them. The reason is that the awareness of some organizations and individuals involved in construction activities regarding compliance with construction laws is not good. In particular, some individuals intentionally violate regulations, carrying out construction work on weekends, holidays, and outside of working hours, within a short period, causing significant difficulties in monitoring and supervising to prevent violations from occurring. The situation where developers allow people to build houses themselves on the land plots designated for auctioned land use rights, even though regulations require the construction of basic structures, has been reduced but still occurs in some projects. Developers lack responsibility in supervising and handling this, leading to people building according to their personal needs without adhering to the approved urban design, such as: combining plots, incorrect facade architecture, expanding and enclosing plots, etc.

To address the aforementioned shortcomings and limitations, the Department of Construction has requested the Provincial People's Committee to direct local authorities to seriously review their responsibilities and immediately rectify the existing shortcomings and limitations in management, especially regarding the issuance of construction permits to households within planned residential areas in new rural areas. This includes addressing the issue of localities that have issued very few construction permits and have not effectively managed construction order. The People's Committees of districts, towns, and cities must closely monitor and direct relevant departments and units to decisively and effectively implement the directives and instructions of the Provincial People's Committee and the Chairman of the Provincial People's Committee on planning management and construction order management in the province. They should also conduct regular or surprise inspections of construction projects to promptly detect, prevent, and resolutely handle violations. In cases of delay or non-compliance with administrative sanctions, enforcement measures must be implemented in accordance with regulations; construction work must not be allowed to continue once violations have been discovered.
