Supervision of response to voters' petitions

Based on his observations, National Assembly Deputy Thach Phuoc Binh ( Tra Vinh National Assembly Delegation) noted that there are still some shortcomings in addressing voters' petitions. The organization of conferences and seminars to gather feedback on draft laws is sometimes merely a formality and not truly effective. During the monitoring process, the evaluation of the implementation of laws and ordinances by competent authorities is often vague, failing to clearly define the responsibilities of the organizations and leaders under supervision. The follow-up and supervision of the implementation of monitoring conclusions and resolutions of the National Assembly on supervision have not received adequate attention, and at times the effectiveness of supervision has been low.

Based on this, Mr. Binh proposed a solution: the National Assembly and the Standing Committee of the National Assembly should improve the method of supervising the resolution of voters' petitions. The National Assembly, the Standing Committee of the National Assembly, the National Assembly delegations, and individual National Assembly deputies should supervise the resolution of voters' petitions through feedback from voters on the resolution results. This means specific regulations on whether voters' opinions on the issues they petitioned about are being promptly and fully addressed by the competent authorities in accordance with the law. In addition, regulations on post-monitoring of the resolution of voters' petitions should be added to promptly request the competent authorities to address newly arising issues.

Representative Siu Huong (Gia Lai Provincial Delegation of the National Assembly) stated that at the 4th Session of the 15th National Assembly, the Gia Lai Provincial Delegation of the National Assembly proposed that the Ministry of Industry and Trade issue a guiding document or propose to the competent authority to issue specific regulations on protecting the safety of wind power projects and compensation for land and assets attached to the land located within the safety corridor of wind turbine towers. This includes determining the affected area, the extent of the impact, and calculating compensation and support for land, houses, crops, barns, and livestock, to serve as a basis for implementation and contribute to stabilizing security and order in localities with wind power projects in Gia Lai province.

The Ministry of Industry and Trade issued document No. 342 dated January 19, 2023, responding to voters' petitions. The Government and the Prime Minister have also been very decisive in directing the resolution of local petitions and proposals, as shown in document No. 622 dated July 5, 2023, regarding the resolution of local petitions and proposals. The Government Office also issued document No. 221 dated March 21, 2024, on implementing the Standing Committee of the National Assembly's report on citizen petitions in December 2023 and January 2024.

However, according to Ms. Huong, to date, no directives or guidelines have been issued from the Government, the Prime Minister, or regarding support for land and assets located within the safety corridor of wind turbine towers of power plants.

“We propose that the Government and the Prime Minister continue to direct relevant ministries and agencies to urgently research and advise the Government on issuing guidelines for compensation and support for land and assets on land located within the safety corridor of wind turbine towers of wind power plants. This will provide a basis for definitively resolving voters' requests and removing obstacles for localities related to wind power projects, not only in Gia Lai province but also in other provinces with wind power projects nationwide. The guidelines should clearly state the expected response timeframe,” said Ms. Huong.

According to National Assembly Deputies Nguyen Huu Thong (Binh Thuan Provincial Delegation), the Binh Thuan Provincial Delegation has received numerous petitions from companies regarding the lending of medical equipment and biological products to healthcare facilities for COVID-19 prevention and control, but these requests have yet to be paid for or resolved. He added that this issue was also raised by deputies at the 6th Session of the National Assembly. The Minister of Health promised to submit a proposal to the competent authorities for a policy solution, but the matter remains unresolved.

Therefore, Mr. Thong suggested that the Ministry of Health advise the competent authorities to promptly issue a document addressing the above issue. At the same time, it should include provisions for calculating interest for businesses from the time they borrowed goods and equipment until now, and a financial mechanism for localities and medical facilities being sued, such as court fees and costs of enforcing judgments. This would make businesses feel that the State and Government care about their development in a reasonable and fair manner, and would also make it easier for localities and medical facilities to implement the measures.
