Adding the right of prisoners to donate tissues and organs.

On the afternoon of October 12th, with a majority of delegates voting in favor, the National Assembly passed the Law on the Execution of Temporary Detention, Custody and Prohibition from Leaving the Place of Residence, and the Law on the Execution of Criminal Sentences (amended).

Before proceeding with the vote, the National Assembly heard Mr. Hoang Thanh Tung, Chairman of the Committee on Law and Justice, present a report on the acceptance, explanation, and revision of the two draft laws.

Mr. Hoang Thanh Tung stated that the two draft laws, after being reviewed, revised, and perfected, closely adhere to the objectives and viewpoints set forth when developing the draft laws. They promptly institutionalize the Party's policy on streamlining the organizational structure of the political system, perfecting the law in the field of criminal sentence enforcement and the enforcement of temporary detention, custody, and prohibition from leaving the place of residence; and overcoming inadequacies and limitations in the practical implementation of related laws.

The draft Law on the Implementation of Temporary Detention, Custody, and Prohibition from Leaving the Place of Residence, after being revised and submitted to the National Assembly for consideration and approval, consists of 12 chapters and 74 articles.

Regarding the implementation of preventive measures prohibiting departure from residence (Chapter VII), Mr. Hoang Thanh Tung stated that some opinions suggested clarifying the meaning of the concept "prohibition from leaving residence." The Standing Committee of the National Assembly has directed the revision of the provisions in Clause 3, Article 3 and Point d, Clause 2, Article 41 of the draft Law to clarify the meaning of the concept "prohibition from leaving residence."

Accordingly, the scope of "prohibition from leaving one's place of residence" is understood as prohibiting departure from the geographical area of ​​the commune, ward, or special zone where the person resides, or the geographical area managed by a military unit, in order to ensure presence as required by competent authorities or individuals.

At the same time, the Standing Committee of the National Assembly also directed a review of all relevant provisions in Chapter VII of the draft Law to clearly determine the application of regulations on prohibiting leaving the place of residence within the geographical area of ​​communes, wards, special zones, or areas managed by military units.

Regarding the draft Law on Execution of Criminal Sentences (amended), after incorporating feedback and making revisions, the draft Law has a structure consisting of 15 chapters and 180 articles.

Regarding the right of prisoners to donate tissues and organs (Articles 23 and 53), many opinions supported adding this right; some opinions suggested that prisoners should not yet be allowed to store eggs and sperm. Mr. Hoang Thanh Tung stated that adding the right of prisoners to donate tissues and organs is a major policy, reflecting the humane stance of the Party and the State towards offenders.

Responding to the opinions of National Assembly deputies, the draft Law stipulates that prisoners may donate tissues and organs in Article 23, and also adds strict conditions in Article 53, including: voluntary donation of tissues and organs; donation only to close relatives; self-responsibility of costs; and only applicable to prisoners who have committed minor or serious crimes for the first time and have less than 3 years remaining on their sentence...

Furthermore, taking into account the opinions of National Assembly deputies, the Standing Committee of the National Assembly agreed with the Government not to regulate the right of prisoners to store eggs and sperm because exercising this right requires significant resources and is difficult to ensure feasibility under current conditions.
