This is a case of violation where the commune authorities have repeatedly warned and requested the individual to dismantle the structure themselves, but they have deliberately refused to comply.

According to inspection records, Mr. Phuc's household constructed two single-story houses with a total area of over 115m² on public land belonging to plot number 280, map sheet number 17, managed by the Commune People's Committee. The first structure, measuring 39.33m², was built with brick walls and a corrugated iron roof; the second structure, measuring 76.37m², was constructed with a steel frame. Upon discovering the violation, the Commune People's Committee issued a suspension order, requested a halt to construction, and urged the family to dismantle the structures themselves, but the violators did not comply.
According to the plan approved by the Commune People's Committee, the Enforcement Steering Committee fully implemented all steps in accordance with the Land Law and regulations on construction order. On December 10th, the enforcement force, including leaders of the Commune People's Committee, commune police, land and construction officials, and local security forces, secured the site and assisted the specialized task force in dismantling all illegal structures, restoring the public land area to its original state for management by The Tru village.

Directing operations at the scene, the Deputy Secretary of the Party Committee and Chairman of the People's Committee of Kieu Phu Commune, Phung Huy Dien, emphasized: "The resolute handling of cases of encroachment on public land is a mandatory requirement to restore order in land management. The commune government will continue to maintain consistency in its direction and resolutely prevent acts of misuse of land and illegal construction in the area." He requested that the enforcement forces carry out their duties according to the correct procedures, ensuring absolute safety for people and property; and assigned the commune's economic and land administration department to continue inspecting and monitoring the site to prevent re-violations.

The Chairman of the People's Committee of the commune also called on the people of The Tru village to cooperate and support the government in handling cases of violations; emphasizing that the consensus of the people is an important factor for the locality to maintain discipline, order and protect public land.
After completely dismantling the illegal construction belonging to Mr. Nguyen Van Phuc, the commune authorities handed over the management to The Tru village, ensuring that no new violations occur. This is considered a strong move by Kieu Phu commune in tightening land management, protecting state assets, and raising people's awareness of law compliance.
