The regime and policies for civil servants and employees working in areas with particularly difficult socio -economic conditions are implemented according to the provisions of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government. According to regulations, the time not counted for enjoying allowances and subsidies includes the time off work to enjoy social insurance benefits according to the provisions of law.
In addition, cadres, civil servants, public employees, workers and salaried persons in the armed forces, if they are simultaneously subject to the policies prescribed in Decree No. 76/2019/ND-CP and subject to the same type of policy according to other legal documents, will only enjoy the highest level of that policy.
Therefore, in case female teachers working in areas with particularly difficult socio-economic conditions take maternity leave, the maternity leave period is not subject to preferential allowance calculation according to the provisions of Decree No. 76/2019/ND-CP and Decision No. 244/2005/QD-TTg of the Prime Minister .

In your case, because the summer vacation completely overlaps with the maternity leave, that is, the summer vacation outside of your maternity leave is 0 days, less than the number of annual leave days you are required to take. Therefore, based on the provisions of Clause 2, Article 6 of Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Minister of Education and Training stipulating the working regime for general education and pre-university teachers, in addition to the maternity leave, you are not entitled to take 8 weeks of summer vacation in compensation, but only an additional number of days equal to the number of annual leave days (number of vacation days) as prescribed by the Labor Code. The additional leave time is flexibly arranged according to the agreement between the teacher and the principal.
