Ms. Mai does not have an employment contract and has submitted a request for income verification to the commune-level police but has not received a result because she was told that there is no guiding document for the implementation of Decree No. 261/2025/ND-CP. Now, the deadline for submitting applications to purchase social housing is almost over.
Ms. Mai asked when there will be sufficient guiding documents for the implementation of Decree No. 261/2025/ND-CP so that eligible individuals can complete their applications for social housing.
Regarding this matter, the Department of Housing and Real Estate Market Management, Ministry of Construction, provides the following response:
The Government has issued Decree No. 261/2025/ND-CP dated October 10, 2025, amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024, and Decree No. 192/2025/ND-CP dated July 1, 2025. Accordingly, Clause 2 of Article 1 amends and supplements Clauses 1 and 2 of Article 30 of Decree No. 100/2024/ND-CP as follows:
"...In the case of individuals specified in Clause 5, Article 76 of the Housing Law who do not have an employment contract, they must ensure that their income meets the requirements stipulated in Clause 1 of this Article and be confirmed by the commune-level police agency where they have their permanent or temporary residence or current address."
Within 7 days from the date of receiving the application for verification, the commune-level police agency where the applicant resides permanently or temporarily, or where they reside at the time of the application, shall use the information from the population database to verify the income eligibility.
On November 10, 2025, the Minister of Construction issued Circular No. 32/2025/TT-BXD amending and supplementing several articles of Circular No. 05/2024/TT-BXD dated July 31, 2024, of the Minister of Construction detailing several articles of the Housing Law. Specifically, Form 05 in the Appendix attached to the Circular provides guidance on documents proving income eligibility for purchasing or lease-purchasing social housing (applicable to subjects specified in Clause 5, Article 76 of the Housing Law who do not have labor contracts and do not receive salaries paid by social insurance), which must be verified by the commune-level police agency where the individual resides, temporarily resides, or currently lives.
