Miss Nguyen Thuc Thuy Tien wins lawsuit against being asked to pay 1.5 billion VND

On the afternoon of November 14, the Ho Chi Minh City People's Court announced the appeal verdict on the case of Property Loan Contract Dispute and Dispute over Non-Contractual Damages Compensation between the plaintiff Ms. Dang Thuy Trang (36 years old, currently living in Lam Dong) and the defendant Nguyen Thuc Thuy Tien (25 years old, Miss Grand International 2021).

The Trial Panel (PC) upheld the original judgment and rejected Ms. Dang Thuy Trang’s appeal. It did not accept Ms. Trang’s request for VND1.5 billion and her request for VND14.9 million in compensation for damage to her honor and dignity.

The panel of judges held that the dispute in the case was about claiming property, not about a loan contract dispute. Therefore, the plaintiff must prove that he or she is the owner of the loaned property and has delivered money to the borrower.

Furthermore, according to the appeal court, Ms. Dang Thuy Trang claimed the property but could not prove that she was the lender nor prove that she had given the money, so there was no basis to accept Ms. Dang Thuy Trang's lawsuit request.

The Court of Appeal also held that the plaintiff's request for the defendant to pay compensation and apologize for insulting his honor and reputation was unfounded.

Previously, the Go Vap District People's Court of First Instance did not accept Ms. Dang Thuy Trang's lawsuit requesting Ms. Nguyen Thuc Thuy Tien to pay a loan of 1.5 billion VND.

Believing that the first instance judgment was inconsistent with the documents, the plaintiff appealed the entire first instance judgment because he believed that this judgment was inconsistent with the documents and evidence in the case file, and at the same time requested the appellate court to accept all of the plaintiff's claims.

According to the lawsuit, Ms. Dang Thuy Trang said that in June 2017, because she needed money to participate in the 2017 Southern Beauty Contest, Miss Thuy Tien proactively asked Ms. Trang to lend her 1.5 billion VND, with the goal of being in the top 3.

On July 12, 2017, Ms. Trang agreed to lend Thuy Tien the above amount. At the same time, Ms. Trang's husband sold the car, the buyer paid in cash, so Ms. Trang took that money and gave it directly to Thuy Tien.

On the day of giving money to Thuy Tien (July 12, 2017), Ms. Trang's husband asked his friend, Mr. Nguyen Quan Trong, to sign the debt confirmation minutes as the party lending Ms. Tien the money, and Ms. Trang was the witness; Ms. Tien also signed, fingerprinted and clearly stated that she had received the full amount.

According to the debt confirmation minutes, Ms. Tien must pay within one year from the date of signing the debt confirmation, and each month Ms. Tien must pay a part of this debt. However, after the debt payment deadline (July 21, 2018), Ms. Tien did not pay the above amount to Ms. Trang.

From there, Ms. Trang requested the People's Court of Go Vap District to consider and decide to force Ms. Tien to pay her a total of more than 2.4 billion VND. At the same time, Ms. Tien was forced to apologize and make public corrections on three newspapers chosen by Ms. Trang.
