Internal procedures, electronic procedures in administrative procedure settlement
Regarding the development of internal procedures and electronic procedures in handling administrative procedures, the Circular stipulates:
Principles for developing internal procedures for handling administrative procedures applying the Quality Management System according to National Standards to the operations of agencies and organizations in the state administrative system. Ensuring simplification, restructuring of procedures, data reuse and implementation regardless of administrative boundaries according to the roadmap, in accordance with legal regulations and implementation practices; timely implementation when administrative procedure regulations come into effect.
For ministries and ministerial-level agencies, the internal process for handling administrative procedures will be implemented as follows: The specialized unit will preside over and coordinate with relevant units to review and develop internal processes for handling administrative procedures for administrative procedures under its authority; consult with specialized units on administrative procedure control to complete before submitting to the Minister or Head of the ministerial-level agency for approval.
For localities, specialized agencies under the provincial People's Committee shall preside over and coordinate with relevant agencies to review and develop internal procedures for handling administrative procedures under the jurisdiction of the provincial and communal levels; consult with specialized agencies and units on administrative procedure control to complete before submitting to the Chairman of the provincial People's Committee for approval.
Based on the approved internal procedures, the Minister, Head of a ministerial-level agency, and Chairman of a provincial People's Committee shall direct the development and promulgation of electronic procedures for handling administrative procedures in the software of the Administrative Procedure Handling Information System at the ministerial and provincial levels for uniform application at ministries, branches, and localities, meeting the requirements for timely implementation when administrative procedure regulations come into effect.
Regulations on photocopying to electronic version, extracting paper data
Regarding photocopying documents to convert to electronic version, the Circular stipulates:
The photocopying of documents into electronic copies as prescribed in Point c, Clause 1, Article 17 of Decree No. 118/2025/ND-CP is carried out in accordance with the provisions of Clause 1 and Clause 2, Article 8 of Circular No. 01/2023/TT-VPCP dated April 5, 2023 of the Minister, Head of the Government Office stipulating a number of contents and measures for implementation in digitizing records, results of handling administrative procedures and performing administrative procedures in the electronic environment (hereinafter referred to as Circular No. 01/2023/TT-VPCP).
Cases where it is not necessary to make copies to electronic versions: Documents submitted to perform administrative procedures in the electronic environment; papers and documents that only require presentation when submitting administrative procedure documents; results of examination, verification, and responses to opinions of agencies and units participating in the process of handling administrative procedures, except in cases where specialized laws provide otherwise; confidential papers and documents as prescribed by law.
Regarding the regulations on data extraction of documents, the Circular requires:
The extraction and updating of information and electronic data prescribed in Clause 2, Article 19 of Decree No. 118/2025/ND-CP shall be carried out in accordance with the provisions of Article 9 of Circular No. 01/2023/TT-VPCP.
Do not extract data for documents and papers: shared in data form by national databases, specialized databases, the National Public Service Portal, the Administrative Procedure Information System at the ministerial and provincial levels and having legal value; documents that are components of administrative procedure settlement dossiers submitted in the form of photocopies, certified copies, except for electronic copies certified from the original; documents and papers that only require presentation when submitting administrative procedure dossiers; confidential documents and papers according to the provisions of law.
The Circular also regulates the suspension of administrative procedures, specifically as follows:
Immediately after receiving a request to stop performing administrative procedures directly or via postal service from an organization or individual according to Clause 1, Article 21 of Decree No. 118/2025/ND-CP, the One-Stop Department where the dossier is received is responsible for checking the status and results of handling administrative procedures.
In case there is no decision to resolve administrative procedures or a document notifying the results of administrative procedure settlement, the One-Stop Department where the dossier is received is responsible for notifying the suspension of dossier settlement according to the Notice of suspension of dossier settlement form prescribed in this Circular.
The National Public Service Portal shall notify the suspension of administrative procedures on the system at the request of organizations and individuals and in accordance with the provisions of Clause 2, Article 21 of Decree No. 118/2025/ND-CP according to the Notice of suspension of processing records form prescribed in this Circular.
This Circular takes effect from the date of promulgation (September 15, 2025).
