On the afternoon of November 7th, a leader of the Dak Lak Department of Finance stated that the Department is advising the Provincial People's Committee to issue a written response to the Krong Pak District People's Committee's request for additional funding to pay for teachers whose contracts were terminated and who won lawsuits, as well as court fees to be paid into the State budget.
According to the head of the Dak Lak Department of Finance, the People's Committee of Krong Pak District must allocate the funds for enforcing the judgment itself. This is because the teachers whose employment contracts were terminated and who won the lawsuit against the People's Committee of Krong Pak District are not eligible for compensation under the Law on State Liability for Compensation.
Previously, based on the judgments that had become legally enforceable and the court fees paid into the State budget, on October 9th, the People's Committee of Krong Pak District submitted a proposal to the People's Committee of Dak Lak Province and the Department of Finance requesting an additional 2.1 billion VND (including interest) to pay teachers whose employment contracts were terminated in the district and who had won lawsuits against schools and the People's Committee of Krong Pak District (the unit with rights and obligations related to the teachers' lawsuits).
The head of the Dak Lak Department of Finance stated that the Krong Pak District People's Committee must independently arrange for the enforcement of the judgment and compensation for the teachers who won the lawsuit.
Since 2021, many teachers whose employment contracts were terminated have sued their schools and the People's Committee of Krong Pak District. Among them, five teachers whose contracts were terminated by Nguyen Thi Minh Khai Secondary School (Krong Pak District) filed lawsuits, and the People's Courts at both levels in Dak Lak Province ruled that Nguyen Thi Minh Khai Secondary School and the People's Committee of Krong Pak District are jointly liable for compensation totaling over 1.2 billion VND. Similarly, another teacher was also ordered by the court to be jointly liable for compensation of over 175 million VND by Ea Kly Secondary School and the People's Committee of Krong Pak District.
As Thanh Nien newspaper reported, from 2011 to 2015, the People's Committee of Krong Pak District massively signed employment contracts without considering actual needs and staffing quotas, leading to a surplus of over 500 contract teachers at the secondary, primary, and preschool levels. Subsequently, many contract teachers in the district lost their jobs.
In 2018, the People's Committee of Krông Pắk District issued a notice forcing many contract teachers at schools in the area to resign, citing the reason that "previous recruitment was not in accordance with regulations, resulting in exceeding the staffing quota assigned by higher authorities." Among the teachers forced to resign, six filed lawsuits alleging that the district had illegally hired and then dismissed them, depriving them of their rights.
Among them, five former teachers at Nguyen Thi Minh Khai Secondary School, namely Nguyen Anh Duong, Nguyen Tuan Anh, Trinh Thi Bich Hanh, H'Dim Nie, and Luong Van Chinh, filed lawsuits. Another teacher who was forced to resign from Ea Kly Secondary School, Ms. Nguyen Thi Binh, also filed a lawsuit.
Both cases have been tried and judged by two levels of courts, the first instance and the appellate court. Accordingly, in April 2022, the Dak Lak Provincial People's Court ruled that Ea Kly Secondary School and the Krong Pak District People's Committee were jointly liable to compensate Ms. Nguyen Thi Binh more than 175 million VND. In June 2022, the Dak Lak Provincial People's Court ruled that Nguyen Thi Minh Khai Secondary School and the Krong Pak District People's Committee were jointly liable to compensate nearly 1.3 billion VND to 5 teachers.
Despite winning their lawsuits more than a year ago, the six teachers who were forced to resign have still not received their compensation.
