According to the 2019 Labor Code, employees will have one day off for New Year 2026, January 1, 2026.
January 1, 2026 is expected to fall on Thursday, so officials, civil servants and workers will have 1 day off with full pay.
11 official Tet holidays
In 2026, employees will have a total of 11 official paid holidays and Tet holidays, including New Year's Day (1 day), Lunar New Year (5 days), Hung King's death anniversary on the 10th day of the 3rd lunar month (1 day), Victory Day on April 30 (1 day), International Labor Day on May 1 (1 day) and National Day on September 2 (2 days).

Cases entitled to 400% salary
Speaking with Tuoi Tre Online , lawyer Tran Ngoc Thich - director of Thich and Associates Law Firm (HCMC) - said that according to the 2019 Labor Code and Decree 145/2020/ND-CP of the Government , employees will receive additional salary if they work on holidays and Tet.
For monthly-salary workers, if they work on Tet holidays, they will receive at least 300% overtime pay (of which 100% is taxable income, 200% is non-taxable income).
As for daily wage workers, if they work on Tet holiday, they will receive at least 300% overtime pay (of which 100% is taxable income, 200% is non-taxable income). In addition, they will also be paid an additional 100% of their Tet holiday salary. A total of 400%.
For example, Ms. Le Thi A (monthly salary) has a salary of 50,000 VND/hour and normally works 8 hours/day, so the salary when working on Tet holiday is 50,000 VND x 300% x 8 hours = 1.2 million VND.
If Ms. Le Thi A works overtime at night on Tet holiday, in addition to 300% of her salary, Ms. Le Thi A will also be paid at least 30% of her salary for work on a normal working day and 20% of her hourly salary during the day of a holiday or Tet holiday.
In which, the hourly wage during the day of a holiday is calculated at least 300% of the actual hourly wage paid for the job being done on a normal working day.
Thus, Ms. A's overtime pay for 8 hours at night during Lunar New Year will be (50,000 VND x 300% 50,000 VND x 30% 20% x 150,000 VND) x 8 hours = 1.56 million VND.
Short formula: (50,000 VND x 390%) x 8 hours = 1.56 million VND. Night working hours are calculated from 10pm the previous day to 6am the next day.
