The Hanoi People's Court has just decided to open the first instance trial of 54 defendants in the "rescue flight" case on July 11. These 54 defendants were prosecuted by the Supreme People's Procuracy for the crimes of "Giving bribes", "Receiving bribes", "Brokering bribes", "Fraudulent appropriation of property" and "Abusing positions and powers while performing official duties".

The trial panel consists of 5 people: 2 judges, 3 people's assessors, with Judge Vu Quang Huy as the chairman of the trial. 5 prosecutors from the Supreme People's Procuracy and the Hanoi People's Procuracy were assigned to exercise the right to prosecute and supervise the first-instance trial at the trial. The trial is expected to last 1 month.
Of the 54 defendants, the Supreme People's Procuracy prosecuted 21 defendants for the crime of "Receiving bribes" as prescribed in Article 354 - Penal Code, prosecuted 23 defendants for the crime of "Giving bribes" as prescribed in Article 364 - Penal Code, prosecuted 4 defendants for the crime of "Abusing position and power while performing official duties" as prescribed in Article 356 - Penal Code, prosecuted 4 defendants for the crime of "Bribery brokerage" as prescribed in Article 365 - Penal Code, prosecuted one defendant for the crime of "Fraudulent appropriation of property" as prescribed in Article 174 - Penal Code, prosecuted one defendant for both the crimes of "Fraudulent appropriation of property" and "Giving bribes".

Two defendants: Vu Ngoc Minh (born in 1961, former Vietnamese Ambassador to Angola), Luu Tuan Dung (born in 1987, former Deputy Head of the Citizen Protection Department, Consular Department, Ministry of Foreign Affairs) were prosecuted for the crime of "Receiving bribes" according to the provisions of Article 354, Clause 3, Point a - Penal Code.
Defendant Ly Tien Hung (born in 1969, former expert of the Department of Science, Technology and Environment, Ministry of Education and Training) was prosecuted for the crime of "Receiving bribes" under the provisions of Article 354, Clause 2, Point c - Penal Code.

Defendant Hoang Van Hung (born in 1980, former police officer) was prosecuted for the crime of "Fraudulent appropriation of property" under the provisions of Article 174, Clause 4, Point a - Penal Code.
Defendant Tran Minh Tuan (born in 1978, Director of Thai Hoa Construction Joint Stock Company) was prosecuted for the crime of "Fraudulent appropriation of property" as prescribed in Article 174, Clause 4, Point a - Penal Code and the crime of "Bribery" as prescribed in Article 364, Clause 3, Point a - Penal Code.
According to the indictment of the Supreme People's Procuracy, when the Covid-19 epidemic broke out and became complicated, the Government directed the organization of flights to bring Vietnamese citizens from abroad back to the country to prevent and fight the epidemic. The Government assigned the Government Office and the Working Groups of a number of ministries, branches and localities to carry out the flight licensing process and the quarantine policy. To implement this policy, during the process of licensing flights, approving local quarantine and resolving the case, from September 2020 to December 2022, 25 individuals took advantage of their assigned positions, powers and tasks to receive bribes totaling nearly 165 billion VND and took advantage of their positions and powers while performing official duties, causing losses of more than 10 billion VND. In this case, the Procuracy identified 23 individuals representing businesses who bribed more than 226 billion VND, 4 individuals who brokered bribes of more than 74 billion VND and fraudulently appropriated nearly 25 billion VND.
