On the afternoon of December 10th, the National Assembly passed the amended Law on Public Employees, significantly expanding the rights of public employees to participate in business activities. Accordingly, public employees are allowed to contribute capital and participate in the management and operation of private enterprises, cooperatives, hospitals, educational institutions, and non-governmental scientific research organizations.

Currently, public officials are not allowed to invest in, establish, or participate in the management of businesses, unless otherwise stipulated by specialized laws. According to the drafting committee, expanding this right represents a major change in the mechanism for utilizing and developing human resources in the public sector.
The amended law affirms that civil servants are allowed to engage in business activities provided they do not violate professional regulations, conflict of interest prevention rules, and professional ethics. Civil servants may also practice a profession as individuals when it is not prohibited by the laws of their respective sector or field.
Furthermore, the law allows public employees to sign labor contracts or service contracts with other agencies or organizations if this does not violate their current employment contract. In cases where the contract does not specify otherwise, the public employee must obtain the consent of the head of the public service unit. The head of the unit, when signing a service contract with another unit, must obtain the approval of their direct supervisor.
Minister of Home Affairs Do Thanh Binh stated that the new regulations aim to institutionalize the policy of linking human resources between the public and private sectors, creating conditions for civil servants to increase their legitimate income from professional activities.
Scientists are recruited as civil servants without having to take an entrance exam.
The amended Civil Servant Law also updates regulations on recruitment. In addition to competitive examinations, civil servants can be recruited based on groups stipulated by the Government. Notably, experts, scientists, talented individuals, those with special aptitudes, experienced individuals, or those currently working under contract at public service units may be recruited as civil servants without having to go through an examination or selection process.
Individuals who are currently civil servants, public employees, or those receiving salaries in the military, police, or cryptographic organizations, if they meet the job requirements and are approved by the competent authority, may also be transferred to the civil servant mechanism without having to take an exam or selection process.
According to Minister Do Thanh Binh, these regulations aim to concretize the policy of attracting and utilizing talent, with recruitment criteria stipulated by the Government for each industry and field.
The amended Civil Servant Law will take effect from July 1, 2026.
