The National Assembly passed the amended Law on Public Officials.

On the afternoon of December 10th, under the chairmanship of National Assembly Chairman Tran Thanh Man and the direction of National Assembly Vice Chairman Nguyen Khac Dinh, the National Assembly voted to pass the amended Law on Public Employees with 437 out of 442 attending National Assembly deputies voting in favor, achieving 98.8%.

Officials are recruited based on job positions.

The law, comprising 6 chapters and 43 articles, stipulates that civil servants are Vietnamese citizens recruited for specific job positions, working at public service units under employment contracts, and receiving salaries from the public service unit's salary fund and other legitimate sources of revenue as prescribed by law.

The general duties of public officials include loyalty to the Communist Party of Vietnam and the Socialist Republic of Vietnam; protecting the honor of the Fatherland and national interests; possessing impeccable and exemplary morals; adhering to the Party's guidelines, policies, and the State's laws; protecting state secrets; safeguarding and protecting public property, using assigned assets efficiently and economically; cultivating and refining professional ethics, and implementing the code of conduct for public officials.

The law stipulates actions that civil servants are prohibited from doing, including: evading, shirking, or passing the buck in performing their assigned duties; creating factions or causing disunity; arbitrarily taking leave or abandoning their jobs; participating in strikes; and posting, disseminating, or making statements containing false information that affects the image and reputation of the country, locality, or unit where they work.

Exploiting professional activities to propagate against the Party's guidelines, policies, and the State's laws, or to harm the customs, traditions, cultural life, and spiritual well-being of the people and society.

There are acts of embezzlement, corruption, waste, misconduct, profiteering, harassment, and other violations of the law in the performance of duties; illegal use of public property and people's property.

Engaging in any form of discrimination based on ethnicity, gender, age, disability, religion, belief, or social class in the performance of duties; insulting the honor, dignity, and reputation of others while performing professional activities.

Prohibited actions according to laws on preventing and combating corruption; laws on thrift and combating waste; laws on enterprises; laws on protecting state secrets; and other prohibited actions as prescribed by law or by competent authorities.

The principle of recruiting civil servants must ensure that it meets the actual needs of the workforce.

The principles for recruiting civil servants are to ensure openness, transparency, objectivity, competitiveness, equality, and compliance with the law. Recruitment must meet actual needs. Successful candidates must immediately meet the requirements of the position they are applying for.

Prioritize recruitment for those who have rendered meritorious service to the revolution, their relatives, ethnic minorities, retired officers and professional soldiers, and other policy beneficiaries as prescribed by law.

Regarding the recruitment of civil servants, it is carried out through competitive examinations and selection processes for each group of candidates as stipulated by the Government.

In addition to the standard recruitment methods, the following individuals, if they immediately meet the job requirements, will be hired as civil servants:

These include experts, scientists, individuals with exceptional talent and aptitude, and those with relevant experience; individuals currently employed under contract at public service units; and other individuals as stipulated by law in their respective sectors and fields.

The law also stipulates that, for individuals currently serving as officials, civil servants, or receiving salaries in the People's Army, People's Public Security, or cryptographic organizations, if they meet the standards and conditions of the job position and receive written approval from the competent agency or unit to transfer to work as civil servants in a public service unit, they are not required to comply with the recruitment regulations in Clauses 1 and 2 of this Article.

Regarding the authority to recruit public employees (Article 18), the Law stipulates that the agency managing a public service unit shall recruit public employees according to the decentralization and authorization of the Ministry, sector, or provincial People's Committee, except for the cases specified in Clause 2 of this Article.

Based on the size of the organization, its field of activity, and its capacity to meet recruitment requirements, the Government regulates the authority to recruit public employees for public non-business units.

In cases where a public non-business unit as stipulated in Clause 2 of this Article has recruitment needs but cannot carry out the recruitment itself, it shall propose that the competent authority as stipulated in Clause 1 of this Article carry out the recruitment.

This law will come into effect on July 1, 2026.
By July 1, 2027 at the latest, ministries, central and local agencies, and public service units must complete the placement and salary classification of civil servants under their management who were recruited before the effective date of this Law, in accordance with its provisions, into appropriate positions.
