Continuing the agenda of the eighth session, on October 28th, the National Assembly discussed in the plenary hall the report of the Supervisory Delegation and the draft Resolution of the National Assembly on the results of the thematic supervision of the implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023.
Representative Nguyen Van Huy, from the National Assembly delegation of Thai Binh province, delivered a speech during the discussion.
Participating in the discussion, delegate Nguyen Van An, from the National Assembly delegation of Thai Binh province, stated that the report clearly reflected the situation regarding the implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023, including achievements, shortcomings, limitations, and their causes.
According to the delegates, overall, the tasks and solutions outlined in the draft Resolution on continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development are not specific enough to be implemented immediately to overcome the limitations mentioned in the monitoring report, specifically: The report pointed out many major shortcomings, limitations, and obstacles in land valuation. However, the solutions related to land valuation presented in the draft Resolution are still general and not specific enough to address practical issues. Therefore, the delegates believe that the solutions need to be reviewed and refined to be more specific, with clear implementation timelines, in order to resolve the obstacles. Regarding the legal review of projects, the draft Resolution assigns the Government to clearly guide the meaning of "not legitimizing violations" to improve the effectiveness of lawmaking and enforcement. Delegates suggested that opinions should be sought from relevant agencies and reports submitted to competent authorities for approval. The Government also needs to promptly provide guidance to ensure feasible implementation. The draft Resolution should also include additional tasks and solutions to limit the improper approval of eligible individuals, the resale of social housing, and to promote the construction of social housing from the state budget for rent… in the coming period to ensure the achievement of the goal of building at least 1 million social housing units for low-income individuals and industrial zone workers during the 2021-2030 period…
Participating in the discussion, delegate Nguyen Van Huy, from the National Assembly delegation of Thai Binh province, assessed that in recent years, Vietnam's real estate market has made significant progress in terms of market size, the number and scale of real estate projects and participating entities, and the diversity of product types. It plays an important role in creating momentum for socio-economic development and contributes to gradually meeting the housing needs of the people.
Referring to the shortcomings pointed out by the Supervisory Delegation, the delegates stated that the real estate and social housing market is not developing sustainably, with an imbalance between supply and demand; real estate prices are still high compared to the income of the majority of people; many urban areas are abandoned, the management of mini-apartments is still inadequate, and there are no effective solutions for dealing with old apartment buildings, failing to ensure the lives of residents; new types of real estate face many legal obstacles, lacking clarity and specificity for regulation…
Delegates pointed out that the first cause mentioned was institutional bottlenecks, and the limitations repeatedly highlighted included overlapping, inconsistent, and unsynchronized regulations in various laws, which were slow to be reviewed, amended, and supplemented. According to the Supervisory Delegation's report, out of a total of 191 general obstacles and shortcomings in both fields from 2015 to 2023, 103 obstacles and shortcomings were in policies and laws on real estate market management; and 60 obstacles and shortcomings were in policies and laws on social housing development… Typical examples of obstacles and shortcomings in real estate market management include regulations on the authority and procedures for deciding on investment policies, granting investment registration certificates, procedures for establishing economic organizations, adjusting, suspending, extending the progress, and terminating investment projects; Regulations concerning public land interspersed within project areas, land allocation and leasing according to land acquisition progress, compensation, support, and resettlement, regulations on the timeframe for implementing land prices; regulations on construction standards and norms, regulations on adjusting transferred projects, construction design; and the review and adjustment of urban planning…
Delegates proposed that the National Assembly and the Government should supplement with specific and sufficiently strong solutions to promptly resolve obstacles for real estate projects that are still facing many difficulties due to prolonged implementation processes, stemming from changes in laws over time, and real estate projects that are delayed due to inspection and audit conclusions, causing delays in processing implementation procedures and resulting in economic losses for businesses and customers who have purchased real estate…
Delegates emphasized that the limitations and obstacles have been identified and are being addressed by the National Assembly and the Government with urgent and timely policy decisions. However, the number of tasks identified is very large. To address these issues comprehensively and effectively, voters and the public earnestly hope that the identified problems and shortcomings will continue to be reviewed and incorporated into legislative tasks as soon as possible, and expect them to be completed within the 15th National Assembly term so that the real estate market and social housing development can better fulfill their role in the economy and contribute to ensuring social security and equity.
