The People's Committee of Ho Chi Minh City decides on measures for the renovation, upgrading, and reconstruction of urban areas.

The resolution stipulates that the People's Committee of Ho Chi Minh City shall decide on measures for urban renovation, upgrading, and reconstruction according to the plan as follows: Demolition of apartment buildings and condominiums that are required to be demolished according to the law on housing; renovation, upgrading, and reconstruction of one or more urban blocks; Assigning the investor to prepare a detailed plan for the urban renovation, upgrading, and reconstruction project for submission to the competent authority for approval.

The competent authority approving the planning is allowed to decide on planning, architectural and population indicators for projects in the historical inner city area that exceed the regulations in the general planning and urban zoning planning on the basis of the overall population balance according to the planning but must ensure the indicators on social infrastructure, technical infrastructure and infrastructure connection of the area.

Based on the City People's Council's decision on the list of urban renovation, upgrading, and reconstruction projects, the City People's Committee decides on the plan for renovating and rebuilding the apartment complex after conducting a representative inspection and assessment of the apartment building and determining that it is subject to demolition; in such cases, a full inspection and assessment of the entire apartment complex is not required.

The City People's Council is fully responsible for deciding on the list of urban renovation, upgrading, and reconstruction projects in the capital city, ensuring a balance of interests between the people, the state, and businesses, preventing losses, waste, and vested interests, and avoiding complex incidents, mass complaints, and disruptions to public order and social security.

The decision to implement coercive measures will be made in cases where the investor has obtained the consent of over 75% of homeowners and land users, equivalent to at least 75% of the area designated for urban renovation, upgrading, and reconstruction as stipulated in point d, clause 2, Article 1 of this Resolution, regarding the planning, compensation, support, and resettlement plan.

The People's Council decides on the level of compensation, support, and resettlement when land is reclaimed.

Regarding land acquisition, land allocation, and land leasing, after receiving guidance from competent authorities allowing the project to proceed as per regulations, the city will use city-level budget funds and other legal sources of capital to independently implement the compensation, support, and resettlement project before approving the investment policy.

In addition to the land acquisition cases stipulated in Article 79 of the Land Law, the City People's Council shall decide on each specific land acquisition case to implement socio -economic development projects for national and public benefit as stipulated in this resolution.

The City People's Council is fully responsible for land acquisition for socio-economic development projects serving the national and public interest, ensuring a harmonious balance of interests among citizens, the state, and businesses, preventing losses, waste, and vested interests, and avoiding complex incidents, mass complaints, and disruptions to public order and safety.

For projects stipulated in point a, clause 2, Article 1 of this Resolution, the city may temporarily allocate a portion of land within the project area to commence construction.

Investors and project owners must fulfill the conditions for commencing construction and the deadlines stipulated in Clause 2, Article 5 of this Resolution, and shall be held responsible in case of failure to comply with these regulations.

The City People's Council decides on the criteria, compensation levels, support, and resettlement when the State reclaims land to implement projects in the City, specifically: For projects specified in point a, clause 2, Article 1 of this Resolution: twice the prescribed level; For projects not falling under the cases specified in point a, clause 2, Article 1 of this Resolution: not exceeding twice the prescribed level.

Furthermore, the resolution assigns the Chairman of the People's Committee of Hanoi City the authority to approve the Master Plan for the Capital City, and to adjust the Master Plan for the Capital City after consulting with relevant ministries and agencies and obtaining approval from the City People's Council.

Before the National Assembly voted, on behalf of the Government and authorized by the Prime Minister, Minister of Finance Nguyen Van Thang stated that, in order to accelerate the implementation of large and important projects that need to be implemented immediately as directed by the Politburo, the Central Party Secretariat, the Government Party Committee, and the Hanoi City Party Committee, the Government has agreed to submit to the National Assembly a mechanism allowing the implementation of land acquisition, compensation, support, and resettlement work as an independent project, to be carried out before the decision and approval of the investment policy.

In response to the opinions of the National Assembly Standing Committee, and to ensure thoroughness in implementation, Clauses 1 and 2 of Article 7 of the draft Resolution have been amended to include provisions assigning the "City People's Council to prescribe criteria, dossiers, conditions, procedures, and processes for implementation..." and "...to bear full responsibility for land acquisition... ensuring a harmonious balance of interests between the people, the state, and businesses, preventing losses, waste, and group interests, creating public consensus, and avoiding complex incidents, mass complaints, and disruptions to public order and safety."
