This revised Higher Education Law project is a replacement law, implementing a two-step development process: identifying policy groups and codifying those policies into a draft law.
The opinions of the National Assembly delegates reflect the dedication, responsibility, and high expectations of the National Assembly for this draft law. In that spirit, the Government has fully incorporated these opinions, comprehensively revised the draft, and provided thorough explanations to create a draft law that is clear in structure, transparent in institution, strong in effect, and enduring over time.
With a spirit of openness, responsibility, caution, and determination to remove institutional bottlenecks, the draft Law has been streamlined, following proper legislative techniques, modern in approach, feasible in implementation, and meeting the requirements for breakthrough development in higher education. The drafting committee identified more than 20 major content groups of interest to delegates, ranging from academic freedom, quality accreditation, accountability, university councils, artificial intelligence… to system models, university governance, digital education, university councils, Party Secretaries…
The drafting committee said that there are some new and breakthrough points in the draft Law on Higher Education (amended):
Firstly, to create breakthrough and pioneering higher education institutions in innovation, training elites, providing high-quality education, and supplying highly skilled human resources to serve the development of the country and humanity;
Establishing a unified higher education system, advanced university governance, and increasing endogenous strength; ending the operation of the University Council in public higher education institutions, strengthening the leadership role of the Party organization in higher education institutions; ensuring comprehensive autonomy of universities in academic space, staff, scientific research and innovation, finance, and international cooperation;
Secondly , breakthroughs in governance at the grassroots level of higher education institutions create synergy and interconnectedness between different levels and specialized training programs; autonomy is a legal right, increasing the decisive role of higher education institutions in higher education activities;
The state manages the system, applying information technology to manage according to standards; seamlessly combining post-audit and pre-audit to ensure the quality of higher education;
Third, innovate university education activities, solutions to promote lifelong learning, control and increase training quality, modernize programs, learning materials, and university education technology; quickly narrow the gap with the labor market, use standards as measuring tools, regulating tools, and controlling output. Strictly control groups of teacher training, health, and law majors.
Fourth, the policy involves investing in higher education institutions to meet and upgrade standards; forming excellent universities to lead the system; ensuring investment resources for the higher education system; the State managing the system, applying information technology to manage according to standards; and seamlessly combining post-audit and pre-audit to ensure the quality of higher education.
Fifth, open corridors, policy mechanisms to attract excellent lecturers, policies to support undergraduate and postgraduate students; Breakthrough policy mechanisms to mobilize all resources, unleash potential, create a creative environment, and a fair competitive playground for stakeholders participating in higher education activities (public, private), and educational institutions.
Sixth, training high-quality human resources associated with scientific research, innovation and pioneering new technology.
The draft Law on Higher Education (amended) has been carefully reviewed, fully absorbed and explained the opinions of National Assembly deputies, ministries, branches, experts and higher education institutions. Throughout the 46 articles of the draft Law submitted to the National Assembly this time is the key phrase "Modernizing higher education, improving the quality of university training".
