Through the Law on Defense Industry, Security, and Industrial Mobilization

Before the National Assembly deputies voted to approve the bill, the Chairman of the National Assembly 's Committee on National Defense and Security, Le Tan Toi, stated that the draft Law on National Defense and Security Industry and Industrial Mobilization, after being revised and amended, has 7 chapters and 86 articles.

Regarding the management of financial resources for the defense and security industry (Article 21), in response to the opinions of National Assembly deputies, the Standing Committee of the National Assembly proposes that the National Assembly remove the phrase "of the Ministry of National Defense, Ministry of Public Security " in Clause 1 and remove the word "Activities" from the title of the Article as in the draft Law submitted to the National Assembly for approval.

Regarding Clause 2, there is a suggestion to study and supplement regulations on the mechanism for directly increasing charter capital from retained after-tax profits of defense industry enterprises, security industry enterprises, or other legally mobilized sources to reduce pressure on the State budget, or to study and supplement regulations on increasing charter capital from the Defense and Security Industry Fund.

Regarding this matter, Le Tan Toi, Chairman of the National Assembly's Committee on National Defense and Security, stated that to ensure the focus and feasibility of allocating after-tax profits, the Standing Committee of the National Assembly proposes that the National Assembly retain the provisions as drafted in the Law.

Furthermore, regarding Clause 4, the Standing Committee of the National Assembly proposes that the National Assembly revise this clause to conform to Clause 4, Article 21 of the draft Law submitted to the National Assembly for approval. With the above provision, along with the assignment to the Government to provide detailed regulations in Clause 6 of this Article, the allocation of after-tax profits will be specifically regulated, prioritized, and ensured to be rigorous and feasible.

Regarding the National Defense and Security Industry Fund, the Standing Committee of the National Assembly proposes that the National Assembly add one point (point a) concerning support from the State budget; revise point b to point c stipulating "Amounts to be allocated from after-tax profits as prescribed in point a, clause 4, Article 21 of this Law"; and rearrange the points of this clause to conform with the draft Law submitted to the National Assembly for approval.

Regarding the proposal to add a provision for the Government to regulate the allocation of the National Defense and Security Industry Fund; and for the Government to report annually to the National Assembly on the results of its operation and management, Mr. Le Tan Toi stated that the Standing Committee of the National Assembly proposed that the National Assembly add the word "allocation" before the word "management" in Clause 4.

Regarding industrial mobilization (Chapter III), after review, the Standing Committee of the National Assembly removed Clause 1 of Article 51 (Article 52 of the draft Law submitted to the National Assembly for approval); assigning the Minister of National Defense to guide the allocation and use of depreciation funds for compensation for losses, management, use, and recovery of specialized equipment and technological documents assigned to industrial mobilization facilities as stipulated in Clause 3. At the same time, other articles in this Chapter were revised and rearranged to ensure consistency, coherence, and feasibility ...
