On the afternoon of September 11th, Prime Minister Pham Minh Chinh chaired a Standing Government meeting on lawmaking, which included considering the drafting of one law to amend and supplement seven existing laws, aiming to overcome limitations, remove obstacles, create a legal framework, and facilitate development.

Attending the meeting were Deputy Prime Minister Ho Duc Phoc; Ministers and heads of ministerial-level agencies; and leaders of relevant ministries, sectors, and agencies.

At the meeting, the Standing Committee of the Government and ministries and agencies reviewed, discussed, and gave opinions on: the draft Law amending and supplementing a number of articles of the Law on Securities, the Law on Accounting, the Law on Independent Auditing, the Law on State Budget, the Law on Management and Use of Public Assets, the Law on Tax Management, and the Law on National Reserves; and the proposal to draft the Law on Promulgation of Legal Normative Documents (amended).

During the discussion and feedback session on the dossiers, procedures, principles, and requirements for drafting the laws, Prime Minister Pham Minh Chinh basically agreed with the content of the proposed policies, while emphasizing some points that need attention to improve the drafting of the aforementioned laws.

Regarding the draft Law amending and supplementing a number of articles of the Law on State Budget, the Law on Management and Use of Public Assets, the Law on National Reserves, the Law on Accounting, the Law on Independent Auditing, the Law on Securities, and the Law on Tax Management, Prime Minister Pham Minh Chinh requested the Ministry of Finance to fully incorporate all relevant opinions; continue to coordinate with relevant agencies and units to carefully review and finalize the content of the draft Law, and report to the Government at the Special Session on Lawmaking in September 2024.

The Prime Minister emphasized that the drafting of the Law must ensure the investment and business rights of citizens; remove as many obstacles and shortcomings in practice as possible; expand mechanisms for mobilizing social resources, people, and businesses for development; use public investment to lead and stimulate private investment; promote maximum decentralization and delegation of power coupled with resource allocation; improve implementation capacity; clearly define the responsibilities of individuals and collectives; and design tools to strengthen inspection and supervision.

In addition, it is necessary to promote the application of digital transformation, reduce administrative procedures and burdens, avoid the "request-and-grant" mechanism in budget revenue and expenditure management, and ensure flexible and efficient budget utilization, especially between the central and local budgets; prevent corruption, negative practices, and waste; and ensure that payment documents are manageable yet transparent...

Regarding the proposal to amend the Law on the Promulgation of Legal Normative Documents, the Prime Minister emphasized the need to strengthen the Party's leadership in lawmaking; to innovate the thinking on lawmaking, responding quickly and flexibly to rapid developments and urgent demands in practice; to develop framework or detailed regulations in the law depending on the subjects and scope of regulation, so as to both manage activities in society and create space to promote and encourage innovation; to innovate the lawmaking process towards greater flexibility, researching ways to shorten the time; to further decentralize and delegate power; to have mechanisms and policies suitable for the team of lawmaking officials; and the principle of applying legal normative documents when there are conflicting documents...

According to the Prime Minister, things that are mature, clear, proven correct in practice, effectively implemented, and supported by the majority should continue to be implemented and codified; new issues that are not yet mature, unclear, or without regulations should be boldly piloted, learning from experience as they go, gradually expanding, without striving for perfection or rushing.

The Prime Minister instructed the Ministry of Justice to incorporate the conclusions of the Standing Committee of the Government, the opinions of the agencies at the meeting, and the opinions of Government members, and to urgently coordinate with relevant ministries and agencies to research and finalize the Proposal for the Law, to be submitted to the Government at the specialized legislative session in September 2024.
