The Inspectorate of Khanh Hoa province has just concluded a thematic inspection of projects facing difficulties, obstacles, delays, and low efficiency in the province, identifying numerous violations at The Art Nest Hotel project.
Land designated for public service facilities is being converted into commercial and service land.
The Art Nest Hotel project was developed on a plot of land measuring 835.75m² at 07 Hung Vuong Street, Loc Tho Ward, Nha Trang City (now 33 Hung Vuong Street, Nha Trang Ward). The total investment for the project was 150 billion VND, and the investor was Forio Nha Trang Co., Ltd.
According to the inspection report, the Khanh Hoa Department of Agriculture and Environment stated that at the time of issuing the investment certificate, based on the adjusted land use plan until 2010 and the 5-year land use plan (2006-2010) of the Khanh Hoa Provincial People's Committee approved by the Government, the aforementioned plot No. 07 was planned as land for the construction of public service facilities.
At the time of land lease in 2009 and 2014, according to the adjusted land use plan up to 2010 and the 5-year land use plan (2006-2010) of the People's Committee of Khanh Hoa province, plot number 07 was planned as land for the construction of public service facilities and the land use plan up to 2020.
Subsequently, in the initial land use plan (2011-2015) of Nha Trang City, approved by the Provincial People's Committee, this plot of land was still planned for the construction of public service facilities.
Regarding land allocation and leasing, the Inspectorate determined that on May 25, 2009, Van Phong Investment and Development Joint Stock Company submitted an application to lease land at 07 Hung Vuong Street. Subsequently, the People's Committee of Khanh Hoa Province issued a decision allowing this company to lease land at 07 Hung Vuong Street to build an office building and a high-class hotel.
In 2024, based on a proposal from the Department of Natural Resources and Environment, the Provincial People's Committee issued a decision to revoke the land leased by Van Phong Investment and Development Joint Stock Company and lease it to Forio Nha Trang Co., Ltd. to implement the Van Phong high-end hotel project.
The inspection determined that the Khanh Hoa Provincial People's Committee leased land to Van Phong Investment and Development Joint Stock Company (purpose of use: land for production and business facilities) and Forio Nha Trang Co., Ltd. (purpose of use: land for commercial and service purposes) to implement the aforementioned project, while the land was zoned for the construction of public service facilities. This violates regulations under the 2003 Land Law and the 2013 Land Law.
Currently, according to the land use plan for Nha Trang City until 2030, the land plot in question is zoned for commercial and service purposes, which is consistent with the project. Therefore, the Inspectorate concludes that the project is currently in accordance with the approved plan.

The inspection report concluded that the Khanh Hoa Provincial People's Committee's determination of the land lease payment date for Forio Nha Trang Co., Ltd. from March 3, 2014, violated the provisions of the 2013 Land Law.
The People's Committee of Khanh Hoa province leased land without auction, violating the provisions of the 2003 Land Law and the 2013 Land Law.
Responsibility for these violations lies with the People's Committee of Khanh Hoa province in 2009 and 2014; the Department of Natural Resources and Environment in 2009 and 2014; and the individuals involved.
Notably, regarding the handling of assets on the land, the Inspectorate determined that the house and land at address No. 07 Hung Vuong Street are under the management of the Center for Housing and Apartment Management.
The People's Committee of Khanh Hoa province has not yet arranged and handled the land and houses at the above address in accordance with the regulations in the Prime Minister 's decision on the rearrangement and handling of state-owned land and houses dated January 19, 2007, but has proceeded to sell the assets on the land through a direct sale, which is a violation.
Responsibility for the violations lies with the Provincial People's Committee, the Provincial People's Committee Office, the Department of Construction, the Department of Finance of Khanh Hoa province in 2008, and the individuals involved.
Based on the above conclusions, the Provincial Inspectorate recommends that the Chairman of the People's Committee of Khanh Hoa province direct, within his authority, or recommend to the competent authority to direct the review and clarification of responsibility for organizations and individuals involved in the shortcomings and violations mentioned in the inspection report, in order to strictly handle them according to the law.
