An important basis for paying civil servants' salaries.
Minister of Home Affairs Do Thanh Binh has just submitted a draft proposal for the development of a Decree regulating civil servant job positions.
The report states that the 2025 Law on Cadres and Civil Servants has completed the basic contents related to the recruitment, use, and management of civil servants. In particular, the law clearly stipulates the transformation of the management method for cadres and civil servants based on job positions.
According to the current Politburo and Secretariat's policy, reviewing and improving job positions is a necessary step to meet the requirements of the two-tiered local government organizational structure, ensuring effectiveness and efficiency, without affecting the normal operation of agencies, organizations, and units, and meeting the needs of serving the people and businesses.

The purpose of issuing this decree is to provide detailed regulations on civil servant job positions; it serves as an important basis for salary payment and for reforming the recruitment, evaluation, planning, training, and professional development of civil servants according to job positions. At the same time, it aims to create a competitive mechanism to improve the quality of cadres, civil servants, and public employees, and to move towards abolishing the "lifetime" employment system.
Based on that, the draft establishes a unified list of six groups: leadership positions, specialized professional positions, general professional positions, support and service positions, positions within the Provincial People's Council, and commune-level civil servant positions. The draft clearly specifies the proportion of civil servants to be assigned to each group of positions at the central and local levels.
The agencies will proactively identify job positions.
Accordingly, at the central level, based on the list of job positions according to the prescribed framework and functions and tasks, ministries and agencies will determine the civil servant job positions to be used in agencies and organizations under their management, serving as the basis for recruitment, employment, management of civil servants and determination of staffing levels.
At the local level, based on the prescribed list of job positions and related decrees, the People's Committees of provinces and cities determine the civil servant job positions to be used in specialized agencies, other administrative agencies and organizations, and the People's Committees of communes under their management, as a basis for recruitment, employment, management of civil servants and determination of staffing levels.
"By implementing this, agencies and organizations will proactively determine the specific job positions to be used within their respective agencies and organizations based on the list of job positions and assigned functions, tasks, and powers as stipulated by competent authorities, without having to wait for guidance documents from the Ministry managing the sector or field as previously required," the Ministry of Interior stated.
According to the draft, ministries, departments, and localities must finalize and re-approve all job positions before December 31, 2026, and complete the placement and ranking corresponding to each position before July 1, 2027.
In cases where a civil servant does not meet the requirements of the position, the agency may arrange for temporary placement for up to 24 months to meet the standards; if they still do not meet the requirements, they may be transferred to another position or have their staff reduced.
The decree on civil servant job positions is currently being reviewed by the Ministry of Justice and is expected to be issued in December.
