Important basis for paying civil servants' salaries
Minister of Home Affairs Do Thanh Binh has just submitted a draft document on the development of a draft Decree regulating civil servant job positions.
The submission stated that the 2025 Law on Cadres and Civil Servants has completed the basic contents related to the recruitment, use and management of civil servants. In particular, the law clearly stipulates the conversion of the method of managing cadres and civil servants according to job positions.
According to the current policy of the Politburo and Secretariat, reviewing and perfecting job positions is an issue that needs to be carried out to meet the requirements of organizing the two-level local government apparatus, ensuring effectiveness and efficiency, not affecting the normal operations of agencies, organizations, units and meeting the requirements of serving people and businesses.

The purpose of issuing the decree is to specify the contents of civil servant job positions; it is an important basis for salary payment and innovation in recruitment, evaluation, planning, training and fostering of civil servants according to job positions. At the same time, there is a competitive mechanism to improve the quality of cadres, civil servants and public employees and move towards abolishing the "lifetime" tenure system.
On that basis, the draft builds a unified list with 6 groups: leadership positions, specialized professional expertise, shared professional expertise, support - service, positions under the provincial People's Council and commune-level civil servant positions. The draft clearly stipulates the proportion of civil servants arranged according to each position group at the central and local levels.
Agencies will proactively identify job positions.
Accordingly, at the Central level, based on the list of job positions according to the prescribed framework and functions and tasks, ministries and branches will determine the positions of civil servants used in agencies and organizations under their management, as a basis for recruiting, using, managing civil servants and determining the payroll.
At the local level, based on the list of job positions as prescribed and related decrees, the People's Committees of provinces and cities determine the job positions of civil servants used in specialized agencies, other administrative agencies and organizations and the People's Committees of communes under their management, as a basis for recruiting, using, managing civil servants and determining the payroll.
“To implement this content, agencies and organizations will proactively determine the specific job positions used in their agencies and organizations based on the list of job positions and functions, tasks and powers assigned according to regulations of competent authorities without having to wait for guidance documents from the Ministry managing the industry or field as previously prescribed,” the Ministry of Home Affairs stated.
According to the draft, ministries, branches and localities must complete and re-approve all job positions before December 31, 2026 and complete the arrangement and ranking of positions corresponding to each position before July 1, 2027.
In case a civil servant does not meet the position requirements, the agency can temporarily arrange for up to 24 months to complete the standards; if he/she continues to fail to meet the requirements, he/she may have to transfer positions or reduce the payroll.
The decree on civil servant job positions is being reviewed by the Ministry of Justice and is expected to be issued in December.
