Identify job positions for specialists to assist the Committees of the Commune People's Council

According to the reflection of Mr. Pham Kien Trung ( Dak Lak ), Clause 1, Section II of Official Dispatch No. 09/CV-BCĐ dated May 6, 2025 of the Steering Committee for the arrangement of administrative units at all levels and the model of organizing 2-level local governments of the Government on temporary orientation for staff arrangement when implementing the arrangement of administrative units and organizing 2-level local governments, the staffing and staffing framework of a commune-level government is about 32 positions.

These positions are arranged in the following positions:

- People's Council leaders: Including 1 Chairman, 1 Vice Chairman (including 1 full-time).

- People's Committee leaders: Including 1 Chairman, 2 Vice Chairmen.

- 2 Committees of the People's Council: Including 2 Committee Heads concurrently held by members of the Standing Committee of the Commune Party Committee, 2 full-time Deputy Committee Heads and 2 civil servants.

- 3 specialized departments of the People's Committee: Each department has 2 full-time leaders and managers; Specialized department civil servants: 4 civil servants/division (total of 12 civil servant positions).

- Public Administration Service Center: 1 Vice Chairman of the People's Committee and Director of the Public Administration Service Center, 1 full-time Deputy Director and 5 civil servants (in case of implementing the 1-level Public Administration Center model, the provincial level will arrange suitable staff).

Thus, according to the guidance in Official Dispatch 09/CV-BCĐ, there are civil servants of the People's Council (specifically 2 civil servants of 2 People's Council Committees at the commune level) and civil servants of the People's Council and People's Committee Offices as separate.

On August 27, 2025, the Ministry of Home Affairs issued Document No. 7159/BNV-CCVC on professional exchange. The document cited Clause 1, Article 15 of Decree No. 150/2025/ND-CP, which stated that the task of advising and assisting the People's Council Committees at the commune level is undertaken by professional civil servants of the People's Council Office and the People's Committee at the commune level.

However, according to the provisions of Clause 1, Article 15 of Decree No. 150/2025/ND-CP, the Office of the People's Council and People's Committee advises and assists the People's Council and the Standing Committee of the People's Council, there is no provision for advising the People's Council Committees.

Therefore, Mr. Trung believes that the consulting and assistance for the People's Council Committees at the commune level by specialized civil servants of the People's Council Office and the People's Committee at the commune level is inappropriate and does not comply with the guidance in Official Dispatch 09/CV-BCĐ of the Steering Committee. Mr. Trung recommends reviewing and correcting the information in Official Dispatch No. 7159/BNV-CCVC dated August 27, 2025 of the Ministry of Home Affairs.

On this issue, the Ministry of Home Affairs responded as follows:

The Ministry of Home Affairs issued Official Dispatch No. 9395/BNV-CCVC dated October 15, 2025 on the direction to supplement the list of job positions at the commune level, in which it guides the job position of specialist to assist the Committees of the People's Council to be arranged at the Office of the People's Council and People's Committee at the commune level, performing the specialized task of advising and assisting the People's Council and the Committees of the People's Council at the commune level according to the provisions of law.
