A stranger unexpectedly transferred several million dong into my account. Afterward, they repeatedly messaged and called me demanding that I return the money. I'm worried this might be a scam.

One reader shared that they had heard many stories and had themselves suddenly received several million dong in their account, only to be asked to return it. "Although I really want to return it, I'm afraid this could be an online scam. So what should I do?", the reader asked.

According to Article 579 of the 2015 Civil Code on the obligation to return property, a person who possesses or uses another person's property without legal basis must return it to the owner or the person entitled to that property.

If the owner or rightful owner of the property cannot be found, it must be handed over to the competent state authority.

In this case, you can report it to the local police station where you live.

Furthermore, according to point c, clause 2, Article 20 of Circular No. 17/2024/TT-NHNN, the account holder is obligated to reimburse or cooperate with the bank or foreign bank branch to reimburse any amounts that were mistakenly credited to their payment account due to errors or mistakes.

According to the law, if someone receives mistakenly transferred money and intentionally fails to return it, they may face administrative penalties. If the amount is large, this act may lead to criminal prosecution.

Therefore, if you receive money transferred to your account by mistake, you should immediately contact the bank where you opened the account to verify and process the refund, or report it to the local police to arrange for the return of this money.

In fact, there are some cases where scammers intentionally transfer money to someone else's bank account by mistake in order to force them into taking out high-interest loans, or use deceptive tactics to guide victims through procedures before stealing their bank accounts.

Therefore, account holders who receive mistakenly transferred funds need to be extremely cautious to avoid falling into scams. When such incidents occur, you should verify the sender's information, how they know your account number, and also save the transaction history.

It's best to contact the bank directly for guidance on how to make a refund in a transparent and clearly confirmed manner.

In particular, to avoid scams, you should absolutely not make refunds or transfer money based on instructions from strangers via text messages or phone calls.

Therefore, there are two ways to return money received due to an erroneous transfer. One is to contact the bank. The other is to report the incident to the competent police authority in your place of residence to verify the information and return the money to the person who made the erroneous transfer. This will avoid potential legal risks and prevent you from getting involved in fraudulent activities.
