The government has passed three decrees on attracting talent and policies for officials in the restructuring of the administrative apparatus.

Kinhtedothi - At a press conference this afternoon, a representative from the Ministry of Interior announced that today (December 31st) the Government approved three decrees on policies to attract and utilize talent; policies and regulations for officials who resign; and policies for officials, civil servants, and public employees affected by the streamlining of the administrative apparatus.


This afternoon, December 31st, the Ministry of Interior held an impromptu press conference to provide information on three decrees that were just approved by the Government today.

Alongside streamlining the organizational structure, policies to attract talented individuals are also necessary.

At the press conference, Deputy Minister of Home Affairs Truong Hai Long stated that, after developing policies on streamlining the political system, the Ministry of Home Affairs recognized the need for policies to attract talented individuals and to utilize outstanding civil servants and public employees.

"Over the past period, the Ministry of Interior has simultaneously implemented and drafted a series of decrees in accordance with the Politburo's directives. Today, these policies have been approved and promulgated by the Government," Deputy Minister Truong Hai Long said.

Here, Mr. Nguyen Tuan Ninh, Director of the Department of Civil Servants, provided information on two Decrees: Decree No. 179/2024/ND-CP dated December 31, 2024, stipulating policies to attract and utilize talented individuals to work in agencies, organizations, and units of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and political-social organizations; and Decree No. 177/2024/ND-CP dated December 31, 2024, stipulating the regime and policies for cases of non-re-election, re-appointment, and officials who resign or retire voluntarily.

Nguyen Quang Dung, Chief of the Office of the Party Committee of the Ministry of Interior, provided information on Decree No. 178/2024/ND-CP dated December 31, 2024, on the regime and policies for cadres, civil servants, public employees, and members of the armed forces in the implementation of the organizational restructuring of the political system.

Notably, Nguyen Quang Dung, Chief of the Office of the Party Committee of the Ministry of Interior, stated that Decree No. 178/2024/ND-CP dated December 31, 2024, consists of 3 Chapters and 27 Articles, outlining 8 important policies.

Policy 1: Policy for early retirement (Article 7): In cases where individuals are 10 years or less past the retirement age under normal working conditions and 5 years or less past the retirement age under working conditions in particularly difficult areas, and have contributed to mandatory social insurance for retirement, they are entitled to the following three benefits:

Firstly, they are entitled to a one-time retirement allowance for early retirement: In the case of early retirement within 12 months: if their age is 5 years or less from the retirement age, they will receive an allowance equal to 1 month's current salary multiplied by the number of months of early retirement; if their age is between 5 and 10 years from the retirement age, they will receive an allowance equal to 0.9 months' current salary multiplied by 60 months.

If the leave is taken from the 13th month onwards, the benefit will be 0.5 times the benefit received for those who take leave for the 12 months mentioned above.

Secondly, they are entitled to early retirement benefits, including: receiving a pension without any reduction in pension rate; receiving an early retirement allowance, including: for those with 2 to less than 5 years remaining until retirement age, an allowance equal to 5 months of current salary for each year of early retirement; for those with 5 to 10 years remaining until retirement age, an allowance equal to 4 months of current salary for each year of early retirement; and receiving an allowance based on years of service with more than 20 years of mandatory social insurance contributions.

If an individual is less than two years from the prescribed retirement age and has sufficient years of service with mandatory social insurance contributions to be eligible for a pension, they are entitled to retirement benefits as prescribed and will not have their pension reduced due to early retirement.

For civil servants and public employees who retire early and are eligible for awards for their contributions but lack sufficient time in leadership positions at the time of retirement, the early retirement period will be calculated based on the remaining time of their current term of office or appointment to that position for consideration of awards for their contributions. For civil servants and public employees who are not eligible for awards for their contributions, the competent authority will consider other forms of awards appropriate to their achievements.

Policy 2: Resignation policy for officials and civil servants (Article 9)

Civil servants who are more than two years away from retirement age and do not qualify for early retirement benefits will receive the following four benefits if they resign:

Firstly, employees are entitled to severance pay: if they resign within 12 months, they are entitled to severance pay equal to 0.8 months of their current salary multiplied by the number of months for which severance pay is calculated; if they resign from the 13th month onwards, they are entitled to 0.4 months of their current salary multiplied by the number of months for which severance pay is calculated (maximum 60 months).

Secondly, they will receive a subsidy equivalent to 1.5 months of their current salary for each year of service with mandatory social insurance contributions.

Thirdly, they are entitled to retain their social insurance contribution period or receive a lump-sum social insurance benefit as stipulated by the law on social insurance.

Fourth, they will receive a subsidy equivalent to three months of their current salary to help them find a new job.

Policy 3: Resignation policy for civil servants and employees (Article 10)

Public officials and employees who resign are entitled to the same four benefits as civil servants who resign, the only difference being that public officials and employees receive unemployment benefits paid by the unemployment insurance fund due to their participation in unemployment insurance.

Policy 4: Policy regarding civil servants and public employees holding leadership and management positions who cease to hold their positions or are elected or appointed to lower leadership and management positions (Article 11): They are entitled to retain their previous salary or leadership allowance until the end of their election term or appointment term.

Policy 5: Policy for personnel on business trips to local areas (Article 12)

To strengthen the deployment of civil servants and public employees at the central and provincial levels to work at the grassroots level (for a period of 3 years), the Decree stipulates 5 benefits, including: continuing to receive salary (including allowances) according to the job position before being sent by the agency, organization, or unit; and receiving an initial allowance equal to 10 months of the basic salary at the time of taking up the position.

In cases where the unit is located in an area with particularly difficult socio-economic conditions, the employee is entitled to the policies stipulated in Government Decree No. 76/2019/ND-CP dated October 18, 2019. After successfully completing their duties at the assigned location, the employee will be reinstated to the agency, organization, or unit that sent them, or assigned to a suitable position no lower than their previous job position by the competent authority; simultaneously, they will receive a salary increase exceeding one level and will be considered for commendation by the Ministry, relevant agencies, and the province in accordance with the Law on Emulation and Commendation.

Policy 6: Policy on prioritizing individuals with outstanding qualities and abilities (Article 13), including: receiving a salary increase exceeding one level; receiving bonuses decided by the head of the agency, organization, or unit, up to a maximum of 50% of the agency, organization, or unit's bonus fund; receiving attention and priority in planning, training, and placement in leadership and management positions, including exceeding the prescribed level; and benefiting from policies to attract and utilize talented individuals to work in state agencies and public service units if they meet the standards and conditions stipulated in the Government Decree.

Policy 7: Policy on training and professional development of civil servants after restructuring (Article 14).

Policy 8: Policies and regulations regarding personnel in the armed forces during the process of reorganizing the organizational structure (Article 15) are the same as those applied to civil servants, public employees, and contract workers in state agencies.

According to the Chief of the Office of the Party Committee of the Ministry of Interior, the purpose of issuing this Decree is to have a good policy to ensure the rights of civil servants and public employees who leave their jobs due to organizational restructuring, contributing to the goal of streamlining the organizational apparatus, restructuring and improving the quality of the civil servant and public employee workforce. At the same time, it aims to retain and value cadres with outstanding qualities and capabilities; and to increase the number of civil servants and public employees at the central and provincial levels assigned to work at the grassroots level (expected 2 cadres per commune) to increase human resources and create momentum for socio-economic development in localities.

“The Decree takes effect from January 1, 2025; and assigns responsibility for guidance and implementation to central ministries and agencies, provincial People's Committees, and agencies, organizations, and units directly managing and employing civil servants and public employees in issuing evaluation criteria and conducting a comprehensive review of the quality of civil servants and public employees under their management. Based on that, identify those who must leave their jobs due to restructuring under this Decree in order to streamline the organizational structure, reduce staffing levels, restructure and improve the quality of the civil servant workforce, and enhance operational efficiency and effectiveness,” Mr. Nguyen Quang Dung emphasized.
