Mr. Thang requested Thanh Vinh Real Estate Investment and Development Joint Stock Company, the project investor, to temporarily stop sending debt collection messages, return interest and issue Land Use Rights Certificates, because the project is currently not eligible to mobilize capital in the form of capital contribution, investment cooperation, business cooperation, joint ventures and associations.

According to the Department of Construction, Cienco4 Group Joint Stock Company is the winning bidder for the investment project to build Hieu 2 Bridge and the road at both ends of the bridge, Thai Hoa town under the form of a build-transfer (BT) contract. Cienco4 Group Joint Stock Company is paid with land funds at 4 locations, including: Long Son 1 Urban Area, Long Son 2 Urban Area, Long Son 3 - Vuc Giong Urban Area and Long Son 4 Urban Area.

The Long Son 1 Urban Area Project was approved by the People's Committee of Nghe An province for detailed construction planning; land allocation and land lease. The Ministry of Natural Resources and Environment approved the Environmental Impact Assessment Report; the Department of Construction issued a Construction Permit for the technical infrastructure project, and the People's Committee of Thai Hoa town issued a Construction Permit for the technical infrastructure connection project and welcome gate.

On April 4, 2023, the Provincial People's Committee issued Decision No. 884 allowing the transfer of part of the Long Son 1 Urban Area project, Long Son ward from Cienco 4 Group Joint Stock Company to Thanh Vinh Real Estate Investment and Development Joint Stock Company.

After being granted the Investment Registration Certificate, Thanh Vinh Real Estate Investment and Development Joint Stock Company has completed the site clearance compensation work, been assigned land for the entire project by the Provincial People's Committee and has been granted the Land Use Rights Certificate for the residential plots of land in the project by the Department of Natural Resources and Environment. The investor has invested in the basic construction of the technical infrastructure system; completed the rough construction, and completed the exterior of 52 houses adjacent to the main urban road.

Director of the Department of Construction Hoang Sy Kien affirmed that, up to now, the Department of Construction has not issued a document announcing that the project is eligible to mobilize capital in the form of capital contribution, investment cooperation, business cooperation, joint venture, association of organizations, households, and individuals; there has not been a document announcing that the project is eligible to sell future housing. However, Thanh Vinh Real Estate Investment and Development Joint Stock Company has mobilized capital from people through reservation contracts.

After listening to the citizen's presentation, the report of the Department of Construction, Thai Hoa town and the investor, concluding this content, Chairman of the Provincial People's Committee Nguyen Duc Trung emphasized that the citizen's recommendations on ensuring rights are civil agreements between citizens and investors. Therefore, he requested that citizens coordinate with investors to resolve the issue according to the law. In case the issue cannot be resolved, citizens have the right to file a lawsuit in court for consideration and resolution.

With the responsibility of State management agencies, to ensure the rights of citizens and investors, and handle issues related to legal procedures of the project, the Chairman of the Provincial People's Committee assigned the Department of Construction to urgently review and inspect real estate investment and business activities at the projects of Long Son 1 Urban Area, Long Son 2 Urban Area and Long Son 4 Urban Area.

Based on the inspection results, the Department of Construction will advise the Provincial People's Committee on a plan to handle issues related to the project's legal procedures, ensure the legitimate rights of the parties and report to the Provincial People's Committee before December 31, 2023. The investor and households will cooperate and prepare relevant contents for the Department of Construction to conduct inspection and review.

Chairman of the Provincial People's Committee Nguyen Duc Trung also requested the Department of Construction to preside over and coordinate with localities with real estate investment projects in the area to strictly implement the contents of State management to ensure that complaints and lawsuits do not occur. Departments and branches create conditions and support investors to carry out legal procedures according to regulations.

Reporting the incident, Chairman of Vinh City People's Committee Tran Ngoc Tu said that the dispute related to the walkway between Mrs. Tran Thi Nhuan's household and Mr. Dau Ngoc Cuong's household had occurred since 2003. In 2017 - 2019, Vinh City People's Committee established an interdisciplinary working group, based on the results of measuring the current land use status of households, showing that the boundary and land use boundary between Mr. Cuong's household and Mrs. Nhuan's household were stable and there was no dispute.

However, Mr. Dau Ngoc Cuong's household has a corrugated iron roof structure on both the recovered and compensated area in 2003 and a part of the area belonging to the safety corridor of Pham Hong Thai Street, and has an increase of 1.1 ^m2 due to encroachment on the area previously belonging to Mr. Tran Quy Ky's land plot (a neighboring household) which had its land cleared in 2003.

The land area used by Mrs. Tran Thi Nhuan's household has increased due to the expansion of a part of the northern traffic road area by 7.5 ^m2 . Mrs. Nhuan's household has opened the gate and built a construction on the land in the direction to Pham Hong Thai street, on the remaining area of ​​Mr. Pham Quy Ky's land that the State had previously recovered and cleared in 2003.

Chairman of Vinh City People's Committee Tran Ngoc Tu said that Ms. Nhuan's proposal to cut part of the railing of Cua Tien bridge to widen the path for households was unfounded, because cutting part of the railing and abutment of Cua Tien bridge to open the path for households would affect the structure of Cua Tien bridge and would not ensure traffic safety during use.

Regarding the content of the reflection that Mr. Cuong's household covered the road with corrugated iron roofs and built a gate across the road, blocking the only way to Mrs. Nhuan's house, Vinh City People's Committee assigned Vinh Tan Ward People's Committee to mobilize households to dismantle the structures in the land that had been compensated and cleared to ensure traffic safety corridors, and at the same time, restore this alley to serve the travel of households in the area before May 30, 2023. However, up to now, the families have not yet dismantled the encroaching structures.

Concluding this content, Chairman of the Provincial People's Committee Nguyen Duc Trung said that although Vinh City and Vinh Tan Ward have paid attention to resolving citizens' petitions, they have not yet resolved the matter completely, allowing the matter to drag on.

To resolve the matter, the Chairman of the Provincial People's Committee requested the Vinh City People's Committee to direct the functional agencies of the city and Vinh Tan ward to urge and mobilize households to dismantle encroaching structures themselves and restore the original status of the land.

In case households do not cooperate, the authorities will draw up a record of violations and strictly handle them according to regulations, resolve the case completely, and report to the Provincial People's Reception Council before December 31, 2023.

Vinh City People's Committee directed Vinh Tan Ward to pay attention to ensuring the legitimate and legal rights and interests of citizens while handling the case, creating favorable conditions for people to travel.
