Chairman of the Provincial People's Committee Nguyen Duc Trung periodically receives citizens in February 2024

Chairman of the Provincial People's Committee Nguyen Duc Trung received two citizens: Nguyen Van Ky and Thai Khac Hoa, both residing in the dormitory of Nghe An Province's Ethnic Boarding High School, block 5, Ha Huy Tap ward, Vinh city.

Mr. Ky and Mr. Hoa complained about Decision No. 198 dated April 4, 2019 of the Provincial People's Committee on recognizing land use rights for the Provincial Boarding High School for Ethnic Minorities; Land use right certificate No. CN 709906 dated April 16, 2019 issued by the Department of Natural Resources and Environment and requested to resolve support, compensation for site clearance and resettlement when the State reclaims land to implement the project of building a number of items of the Nghe An Provincial Boarding High School for Ethnic Minorities.

According to the records, on July 3, 1984, the People's Committee of Nghe Tinh province issued Decision No. 1192 QD/UB allowing Nghe Tinh Highland High School, now the Provincial Boarding High School for Ethnic Minorities, to use the old land of the Agricultural Machinery Design Institute with an area of ​​13,000m2 to build its headquarters.

The dormitory area of ​​the Provincial Boarding Ethnic High School is part of the land area that the Provincial People's Committee has allowed the Provincial Boarding Ethnic High School to use. On April 16, 2019, the Department of Natural Resources and Environment issued a Certificate of Land Use Rights to the Provincial Boarding Ethnic High School with an area of ​​11,234.2 m2, including the dormitory area.

The land plot used by Mr. Thai Khac Hoa was originally lent by the Provincial Boarding Ethnic High School for the school's dormitories, with a housing loan contract. The land plot used by Mr. Nguyen Van Ky was originally lent by the Provincial Boarding Ethnic High School for the school to build housing since 2006, located entirely within the school's land plot.

On that basis, Director of the Department of Natural Resources and Environment Hoang Quoc Viet said that, based on regulations, the complaints of Mr. Nguyen Van Ky and Mr. Thai Khac Hoa fall into the cases that cannot be accepted for settlement as prescribed in Article 11 of the 2011 Law on Complaints, so there is no basis for settlement.

On the other hand, based on the provisions of the 2013 Land Law and the results of inspection and confirmation of the origin and land use process of households and individuals, when implementing the Investment Project to build new works of a number of works of the Provincial Boarding High School for Ethnic Minorities, the State will not recover land and compensate, support and resettle according to the provisions of the law on land.

After listening to the opinions of citizens and members, concluding the citizen reception session, Chairman of the Provincial People's Committee Nguyen Duc Trung said that, in the past time, the Provincial People's Committee directed the sectors, localities, and the Provincial Boarding High School for Ethnic Minorities to consider and resolve and have issued a written notice to respond to citizens' complaints and recommendations.

According to reports and records, the land belongs to the Provincial Boarding High School for Ethnic Minorities, which has been granted a Land Use Rights Certificate by the State in accordance with regulations. It is appropriate for the school to take back the land area previously lent to citizens.

However, through the citizens' petitions, realizing that there are some issues that need to be clarified to ensure the legitimate rights of citizens in accordance with regulations, Chairman of the Provincial People's Committee Nguyen Duc Trung assigned the Provincial Inspectorate to establish a working group consisting of sectors, Vinh City, and the Provincial Boarding Ethnic High School to review the entire origin and land use process of the school and households, as well as the issuance of the Certificate of Land Use Rights to the Provincial Boarding Ethnic High School for consideration and handling in accordance with regulations; report to the Provincial People's Committee, respond to citizens before March 31, 2024. In case citizens are eligible, support will be considered in accordance with regulations.

Chairman of the Provincial People's Committee Nguyen Duc Trung also requested the Vinh City People's Committee to base on Decision No. 78 of the Provincial People's Committee to consider the circumstances of Mr. Nguyen Van Ky's family. If qualified, grant him land in the form of valuation, ensuring understanding and reason.

Based on the settlement results, the Chairman of the Provincial People's Committee also requested citizens to facilitate the handover of the site so that the Provincial Boarding High School for Ethnic Minorities can implement the project on schedule.
