What happens when an artist's hit is copied by AI to compete?

On the afternoon of December 5, the Intellectual Property Association of Ho Chi Minh City coordinated with Phan Law Vietnam Law Office to organize a discussion with the topic "Copyright exceptions for AI and their impact on Vietnam's creative industry" in Ho Chi Minh City.

Lawyer Phan Vu Tuan (Vice President of the Ho Chi Minh City Intellectual Property Association - Head of Phan Law Vietnam Law Office) said that considering adding exceptions for text and data mining (TDM) activities to the Law amending the Law on Intellectual Property is a requirement in the context of rapid development of AI technology.

According to Mr. Tuan, this exception is only effective when built on the principle of balancing the community's right to access knowledge and the need to create a favorable legal environment for the development of new technology.

"Only by maintaining this balance can the TDM exception support AI development without affecting the goal of protecting intellectual property rights," Mr. Tuan emphasized.

From the music industry perspective, Mr. Tao Minh Hung, representative of the International Federation of the Phonographic Industry (IFPI) in Vietnam, said the rapid development of AI is creating many big challenges for the creative industry.

According to Mr. Hung, although some AI developers cooperate or request permission to use copyrighted data, many units still arbitrarily exploit this content to train models without negotiation or payment. This allows them to profit from the work of artists, while creating products that directly compete with the original works used as input data.

Mr. Hung believes that the addition of an exception for TDM activities in the draft amendments to the IP Law should be considered carefully. AI developers can still access data through a licensing mechanism like any other form of copyright exploitation. If the exception is applied too broadly, this will undermine efforts to build a healthy licensing market for AI training activities and lead to the risk of reducing copyright value in the recording industry.

"Therefore, the TDM exception needs to be carefully studied to ensure sustainable development for Vietnam's cultural and creative industries," Mr. Hung emphasized.
