On the morning of August 27, Prime Minister Pham Minh Chinh chaired a specialized government meeting on lawmaking, discussing and giving opinions on three draft laws: Management and Investment of State Capital in Enterprises (amended); Teachers; and Digital Technology Industry.

This is the second thematic legal session in August 2024 and the eighth thematic legal session of the Government this year.

Attending the meeting were deputy prime ministers, ministers, and heads of ministerial-level agencies and government agencies.

At the meeting, the Government heard presentations on the summary of draft laws and reports on the incorporation of appraisal comments; and also discussed the policy contents of the draft laws.

Giving specific feedback on each topic of discussion, Prime Minister Pham Minh Chinh analyzed and further emphasized several points regarding the drafting of the bills.

In general, The Prime Minister requested that the Party and State's guidelines and policies on related issues be fully adhered to and institutionalized; and that the proposals for drafting laws be closely followed and clearly reflected in the policies already approved by the Government.

Furthermore, we must continue to innovate in the thinking behind lawmaking, promote thorough decentralization and delegation of power, while allocating resources, enhancing enforcement capacity, and designing tools to strengthen supervision, inspection, and control of power.

The Prime Minister requested a strengthening of post-inspection, clear assignment of responsibilities to specific individuals, tasks, and outcomes; a reduction and simplification of administrative procedures, elimination of the "request and grant" mechanism, and a reduction in intermediate steps.

Strengthen close and effective coordination among ministries, departments, and agencies, and establish appropriate incentive mechanisms for areas that need encouragement.

"The policy mechanisms must be open, feasible, but controllable; including appropriate and effective policies to train and cultivate high-quality human resources related to the three areas regulated by the three draft laws; and mobilizing all legitimate resources for national development," the Prime Minister stated.

Regarding the draft Law on State Capital Management and Investment in Enterprises, the Prime Minister requested a review to address shortcomings and obstacles arising in practice, inheriting provisions that have been proven effective in practice from the current law, and ensuring consistency and uniformity with related legal provisions such as the Investment Law, the Public Investment Law, the Enterprise Law, the Construction Law, etc.

The Prime Minister also stated that management should focus on objectives.

In addition to stronger decentralization and delegation of power, granting more autonomy to businesses must go hand in hand with appropriate resource allocation, improved implementation capacity, and the design of inspection and monitoring tools.

Therefore, it is essential to improve investment efficiency, maximize the effectiveness of the enormous resources available in enterprises; promote the pioneering role of state-owned enterprises in certain sectors, as well as the overall important role of state-owned enterprises in the economy, and enhance the leading role of the state economy.

Regarding the draft Law on Teachers, The Prime Minister emphasized the need to improve the quality of the teaching staff, meeting the requirements, tasks, and mission of nurturing future generations in the new context, with the view that "teachers are the driving force and source of inspiration for students."

General conclusions of the meeting, Prime Minister Pham Minh Chinh requested that ministers direct the serious and thorough consideration of valid opinions, and finalize draft laws in accordance with the Law on the Promulgation of Legal Documents and related documents, in order to submit them to the National Assembly at the 8th session in October 2024.

"These laws contain many new and complex provisions. The Prime Minister has requested that ministers establish working groups with the participation of experts and personnel from other ministries, sectors, and agencies; and continue to listen to experts, scientists, and those affected," the Prime Minister said.

He instructed the deputy prime ministers, assigned to specific areas of responsibility, to directly oversee the completion of draft laws, ensuring timely progress and improving their quality.
