On October 15th in Hanoi, the Vietnam Real Estate Association, in collaboration with the Ministry of Natural Resources and Environment and the Ministry of Construction, organized a dialogue conference between law-making bodies, experts, businesses, and the press on understanding and applying the Land Law, Housing Law, Real Estate Business Law, and their implementing guidelines to the practical operations of real estate businesses.

In accordance with Prime Minister 's Directive No. 79/CD-TTg dated August 13, 2024, on effectively implementing the Land Law, Housing Law, and Real Estate Business Law; and based on the opinions of leaders from relevant ministries and sectors; and after surveying the actual operations and needs of the real estate business community, the Vietnam Real Estate Association plans to implement a communication project to effectively disseminate and enforce policies and laws on land, housing, and real estate business.
The project comprises a series of activities organized by the Vietnam Real Estate Association in coordination with the Ministry of Natural Resources and Environment and the Ministry of Construction, following the directive of Deputy Prime Minister Tran Hong Ha in Official Letter No. 7058/VPCP-NN.

The first event in the series is a Dialogue Conference between law-making bodies, experts, businesses, and the press on understanding and applying the 2024 Land Law, the 2023 Housing Law, the 2023 Real Estate Business Law, and their implementing guidelines to the practical operations of real estate businesses.
The objective of the communication project, including the Dialogue Conference, is to disseminate information about the new points and important issues that citizens and businesses need to pay attention to in the three new laws and their implementing guidelines, in order to understand them correctly and fully, and to apply and implement them synchronously and effectively. In addition, the Conference provides space to listen to the opinions and suggestions of businesses, thereby addressing concerns or difficulties that have arisen or may arise in the practical application of the new legal framework on land, housing, and real estate business for citizens and businesses. At the same time, it clarifies the impacts of the new laws on the operations and investment environment of real estate businesses, including both opportunities and risks, and provides appropriate recommendations for businesses. To provide recommendations and proposed solutions to further improve policies and laws on land, housing, and real estate business, aiming to create a favorable business environment for enterprises.

The conference was divided into two sessions. The morning session focused on: Effectively applying the 2024 Land Law and its implementing guidelines to the practical operations of real estate businesses. Accordingly, the conference listened to presentations from representatives of the Ministry of Natural Resources and Environment, the National Assembly's Economic Committee, and experts on: Notable new points of the 2024 Land Law and its implementing guidelines; Understanding and effectively implementing the 2024 Land Law and opportunities for real estate businesses; Points to note in the process of guiding, applying, and implementing the 2024 Land Law by localities and real estate businesses, especially regarding issues with multiple interpretations. In addition, the conference focused on clarifying "hot" issues related to: Land planning and projects; Auction and bidding for projects; Land valuation methods and land price tables; Determining specific land prices for cases where land was allocated or leased before the 2024 Land Law; transitional provisions; impacts on real estate businesses and real estate prices when applying the new land price calculation method...; and other issues that need to be further specified accurately and fully in detailed regulations and implementation guidelines.

The afternoon session focused on the theme: Implementing the 2023 Housing Law and the 2023 Real Estate Business Law: Opportunities, Challenges, and Issues to Note for Localities and Real Estate Businesses. During this session, the conference heard presentations from representatives of the Ministry of Construction on: New aspects impacting real estate businesses under the 2023 Real Estate Business Law, Housing Law, and their detailed regulations; and expert presentations on: Points to note in the process of guiding, applying, and enforcing the Housing Law and the Real Estate Business Law by local authorities and real estate businesses.
Simultaneously, during the discussion, representatives from the drafting agency and experts will focus on exchanging, clarifying, and answering concerns from businesses related to: Capital mobilization from the business of housing and construction projects under construction; transfer of real estate business contracts; guaranteeing the financial obligations of investors in the business of real estate projects under construction in cases where buyers do not request a guarantee; the legal basis for investing in and doing business with condotel and officetel products; social housing, renovation of old apartment buildings, housing standards and regulations…; and other prominent issues that need to be further specified correctly and fully in detailed regulations and implementing guidelines to improve the effectiveness of implementation in practice and facilitate investment and business activities of enterprises.

Following the Dialogue Conference, the Vietnam Real Estate Association will report to the Prime Minister on recommendations and proposals to further improve the implementation of laws, effectively bringing new policies and laws on land, housing, and real estate business into practice, promoting healthy and sustainable market development, and protecting the legitimate rights and interests of citizens and businesses.
