One of the notable new features is the requirement for business households to declare all account numbers related to their production and business activities.
According to current regulations in the 2019 Tax Administration Law, business households only need to notify the tax authorities of the bank account used for electronic tax payment. However, the new draft regulations, in Article 9, require business households and individual businesses to notify the tax authorities of all accounts used for business activities, not just the tax payment account.
The Ministry of Finance believes this regulation aims to strengthen control over the cash flow and revenue of business households, contributing to reducing tax evasion. In addition to the regulations on account declaration, Article 9 of the draft Decree also clarifies other rights and responsibilities of business households and individual businesses.
Specifically, taxpayers have the right to request guidance and clarification from the tax authorities regarding tax declaration, calculation, and payment.
Household businesses and individual business owners must fully and accurately declare their generated revenue to determine their tax obligations according to regulations. They are also responsible for using accounting books and invoices correctly, and for providing books, invoices, sales management software, and related documents when requested by the tax authorities for inspection.
For business activities conducted on e-commerce platforms, households and individuals residing in Vietnam must declare and pay various taxes such as: excise tax, environmental protection tax, resource tax, environmental protection fee, and other fees under the management of the tax authorities.
Furthermore, businesses operating on digital platforms must provide complete and accurate identification information, including tax identification numbers or personal identification numbers for Vietnamese citizens; and passport numbers or foreign-issued identification information for foreign individuals. They must also provide documents to determine tax obligations and other mandatory information to the e-commerce platform operator as required by law.
