Draft Law on Press (amended): Carefully review press development policies, ensure resources for implementation

Giving opinions on the reception and revision of the draft Law on Press (amended), the National Assembly Standing Committee proposed to continue to carefully review press development policies, ensure resources for implementation, especially financial mechanisms to support the press in performing public service tasks and tasks assigned by competent authorities, invest in infrastructure, and provide tax incentives to ensure feasibility.

On the morning of December 4, continuing the 52nd Session, under the direction of Vice Chairman of the National Assembly , Senior Lieutenant General Tran Quang Phuong, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Press Law (amended).

Ensure standardization of professional skills and ethics of journalists

At the meeting, the National Assembly Standing Committee listened to Chairman of the Committee on Culture and Social Affairs Nguyen Dac Vinh present a report on receiving, explaining and revising the draft Law on Press (amended).

Commenting on the reception, explanation and revision, National Assembly Chairman Tran Thanh Man acknowledged and highly appreciated the drafting agency and the review agency for receiving and revising many contents based on comments from the National Assembly Standing Committee and National Assembly deputies.

Raising issues of concern to National Assembly deputies regarding this draft Law, the National Assembly Chairman emphasized the need to review and complete regulations on: policies for press development; press management in cyberspace and the issue of artificial intelligence (AI); protecting the safety of journalists' work; licensing and management conditions for collaborators; definition and legal status.

The National Assembly Chairman highly agreed on amending specific and feasible regulations on press support policies and tax incentives for the press as stipulated in the Law on Corporate Income Tax. Accordingly, press agencies are entitled to a tax rate of 10%, instead of previously only print press was entitled to this tax rate, other types of press were subject to a tax rate of 20%.

The National Assembly Chairman also noted that, to ensure copyright and related rights, the draft Law has added Clause 2, Article 39 in the direction that agencies, organizations and individuals using press works must reach an agreement with the press agency according to the provisions of law.

At the same time, the draft Law also supplements regulations on training and fostering press human resources, to ensure standardization of professional skills and ethics, and improve the capacity of journalists (Clause 4, Article 12); fostering professional ethics and press skills for journalists (Clause 4, Article 13). Clauses 1 and 2, Article 29 specifically stipulate the subjects eligible for press cards, conditions, standards, procedures, and procedures for granting press cards to ensure strictness and correctness for the subjects.

In addition, Article 39 of the draft Law has added a provision: press agencies, authors, and works only use artificial intelligence to support press activities, must comply with intellectual property regulations and professional ethics; press agencies are responsible for regulating the use of artificial intelligence in their agencies.

"At this 10th Session, for the first time, the National Assembly will promulgate the Law on Artificial Intelligence (AI), which has content related to the draft Law on Press (amended) this time." Emphasizing this issue, the National Assembly Chairman suggested that agencies must carefully and comprehensively review the draft Law with current laws as well as related Law projects being amended and supplemented, to ensure consistency and uniformity in regulations related to press, science and technology, digital transformation, information security, advertising and intellectual property.

“The drafting agency and the reviewing agency, although having reached an agreement, still have to actively sit down and review each clause, each article, each chapter to make adjustments, so that the draft Press Law (amended) is passed by the National Assembly with high consensus, coupled with implementation instructions to ensure the law has a long "lifespan", thereby further improving the effectiveness of press management in the coming time,” the National Assembly Chairman emphasized.

As the agency in charge of reviewing the Artificial Intelligence Law project, Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai said that the Committee has proposed to add contents related to the application and use of artificial intelligence in scientific research, education and training and in the press and media. However, the Government is currently accepting the direction that the contents of using AI in specialized fields will be regulated in specialized laws.

Therefore, although there is not much time left to complete the draft Law, Chairman of the Committee Nguyen Thanh Hai suggested considering adding a "framework" article to ensure consistency and coordination between laws when put into practice.

“Specialized laws such as the Law on Higher Education, the Law on Vocational Education, and the Law on Education (areas heavily influenced by AI), if possible, can supplement framework regulations,” the Chairman of the Committee on Science, Technology and Environment emphasized.

Do not leave any “gaps”

Basically agreeing with the content of the draft Law that has been absorbed and revised, Chairman of the Law and Justice Committee Hoang Thanh Tung also proposed to continue clarifying and regulating in accordance with Clause 9, Article 2 on the interpretation of terms. Clause 9 is currently explaining the phrase "national digital press platform". Thus, the national digital press platform is identified as an information technology system. However, Clause 11, Article 2 on "press products" identifies the national digital press platform as also a press product.

“These two clauses in Article 2 of the draft Law are not really connected to each other and are not clearly defined. If it is an information technology system to serve the management and support of press activities, it cannot be a press product.” Therefore, the Chairman of the Law and Justice Committee suggested that the provisions in Clauses 9 and 11 related to the national digital press platform need to be further reviewed for clarity.

Concluding on this content, Vice Chairman of the National Assembly Tran Quang Phuong suggested continuing to thoroughly review and ensure consistency and uniformity in the legal system, especially ensuring consistency with the Artificial Intelligence Law project. Because, in receiving, this draft Law determines that it will only regulate the framework, the content is in specialized laws. The Press Law project (amended) is one of the specialized laws that also needs to regulate this content.

Especially the financial mechanism to support the press in performing public service obligations and tasks assigned by competent authorities, invest in infrastructure, and provide tax incentives to ensure feasibility.

The Vice Chairman of the National Assembly also suggested that it is necessary to clarify the conditions for press activities, licensing mechanisms and organizational structure, especially the regulations on press types, criteria for key multimedia press agencies, representative offices, and resident reporters, which need to be closely reviewed. Review regulations on press cards, legal responsibility for information content, and the right to request correction and removal of violating information.

Vice Chairman of the National Assembly Tran Quang Phuong also noted the need to review and improve regulations on the management of press activities in cyberspace and the application of new technologies, including the regulation of behavior, application and use of artificial intelligence; on the safety of life and dignity of journalists; on training and fostering journalist capacity, fostering professional ethics of journalists, granting journalist cards, etc. It is necessary to be consistent with relevant laws and try not to leave gaps due to related contents.
