1. The necessity of issuing the Resolution - Clause 15, Article 38 of Government Decree No. 103/2024/ND-CP dated July 30, 2024, on land use fees and land lease fees stipulates: “15. Based on the actual conditions of the locality, the People's Committee of the province shall submit to the People's Council of the same level for decision on preferential regimes for exemption from land lease fees for each area and field for projects using land for production and business purposes in investment-incentive fields (investment-incentive industries and professions) or in investment-incentive areas as prescribed in point a, clause 1, Article 157 of the Land Law that meet one of the two conditions: The project belongs to the list of types, scale criteria, and standards of socialization decided by the Prime Minister ; the project is non-profit…”. - Point a, Clause 7, Article 48 of Government Decree No. 103/2024/ND-CP dated July 30, 2024, stipulates the responsibilities of the Provincial People's Committee as follows: “7. It is responsible for submitting to the People's Council at the same level for decision: a) Preferential land rent exemption regimes for each area and sector for projects using land for production and business purposes in investment-incentive sectors (investment-incentive industries and professions) or in investment-incentive areas as prescribed in Point a, Clause 1, Article 157 of the Land Law, provided that the project meets one of two conditions: The project belongs to the list of types, scale criteria, and standards of socialized projects decided by the Prime Minister; or it is a non-profit project as prescribed in Clause 15, Article 38 of this Decree.”   Therefore, the issuance of a Resolution by the Provincial People's Council stipulating the preferential regime of exemption from land rent for projects using land for production and business purposes in investment-incentive fields (investment-incentive industries and professions) or in investment-incentive areas in Lai Chau province is necessary and in accordance with the provisions of the law. 2. Basic content of the Draft Resolution - The basic content of the Draft Resolution is to regulate the preferential regime of exemption from land rent according to each area and field for projects using land for production and business purposes in investment-incentive fields (investment-incentive industries and professions) or in investment-incentive areas as prescribed in point a, clause 1, Article 157 of the Land Law that meets one of the two conditions: (1) The project belongs to the list of types, scale criteria, and standards of socialization decided by the Prime Minister; (2) Non-profit project. - Preferential regime of exemption from land rent (1). Projects using land for production and business purposes in investment-incentive fields (investment-incentive industries and professions) in Lai Chau province are socialized investment projects: Exemption from land rent for the entire lease period after the land rent exemption period for the basic construction period. (2). Projects using land for production and business purposes in investment-incentive fields (investment-incentive industries and professions) in Lai Chau province are non-profit projects: Exemption from land rent for the entire lease term.
