Raytheon Company Defrauded the US Department of Defense of Nearly $1 Billion on Patriot Missiles and Radars

The Hill newspaper reported on October 19 that weapons company Raytheon will have to pay more than $950 million to resolve allegations by the US Department of Justice of fraud against the Department of Defense and paying bribes to a government official in Qatar to do business in that country.

Raytheon, part of RTX, was charged with "a massive government fraud conspiracy involving mispricing of certain government contracts and violations of the Foreign Corrupt Practices Act and the Arms Export Control Act," according to a statement from the US Department of Justice.

In addition, Raytheon was accused of violating the regulations and violating the International Traffic in Arms Regulations.

Raytheon will enter into three-year deferred prosecution agreements in separate cases filed in federal courts in Massachusetts and New York on Oct. 16. The company also agreed to hire independent monitors to ensure compliance with anti-corruption and anti-fraud laws.

At the heart of the allegations in the Massachusetts case are missile systems that Raytheon sold to the US Department of Defense from 2011 to 2013 and the operation of a radar surveillance system in 2017. The company is accused of inflating its costs by $111 million in those transactions.

Raytheon is accused of lying to the Pentagon about the cost of building three Patriot missile systems, with the military agreeing to a $619 million contract.

Justice Department investigators uncovered a 2013 email in which Raytheon told the Pentagon that its projected costs had increased, when they had actually decreased, costing the government about $100 million more, according to court filings.

In 2017, Raytheon allegedly misled the Air Force about the costs of operating and maintaining a radar surveillance system to inflate the contract by $11 million, prosecutors said.

In the New York case, Raytheon is accused of bribing a senior Qatari Air Force official from 2012 to 2016.

"For years, Raytheon employees bribed a senior Qatari military official to secure lucrative defense contracts and concealed the bribes by falsifying government documents, violating laws including those designed to protect our national security," Attorney General Breon Peace wrote in a statement from the Justice Department.

RTX said it “takes responsibility for the misconduct that occurred” and is “committed to maintaining a world-class compliance program, adhering to global laws, regulations and internal policies, while maintaining integrity and serving our customers ethically.”
