(Dan Tri) - Tan Tan Joint Stock Company started out as a fried peanut processing facility, then built a factory and established a company. The company was famous for its peanuts but later evaded taxes.

The People's Procuracy of Region 16, Ho Chi Minh City has just issued an indictment, prosecuting defendant Tran Quoc Tan - former Director of Tan Tan Joint Stock Company - for the crimes of Tax Evasion and Failure to Comply with the Judgment.

For tax evasion, Mr. Tran Quoc Tan was accused of renting out houses, factories and warehouses of Tan Tan Joint Stock Company, generating revenue but not issuing invoices, not declaring or reporting taxes, thereby evading 1.93 billion VND in taxes.

In addition, in 2014, Tan Tan Joint Stock Company also left out of the books revenues from sales and processing even though it still issued invoices. This violation resulted in unpaid taxes of more than 1.5 billion VND, bringing the total amount of tax evasion to nearly 3.5 billion VND.

According to the National Business Registration Portal, Tan Tan Joint Stock Company was established in 2007, located in Dong Hoa Ward, Di An City, former Binh Duong Province (now Ho Chi Minh City). However, on the website, the company introduces itself as having been established and developed for more than 40 years.

In 1984, the company started out as a fried peanut processing facility. By 1997, the facility had built a new factory and office in the former Binh Duong province with an area of ​​over 45,000m2, expanding its staff to over 800 employees.

Since then, the company has expanded its domestic business scale with more than 140 distributors, more than 40,000 retail outlets in most supermarkets and shopping centers, accounting for 80% of the market share nationwide.

Tan Tan has also successfully exported to markets around the world such as the US, Korea, China, Nigeria, Cuba...

Back at the time of establishment, Tan Tan's charter capital was 80 billion VND. Of which, Mr. Tran Quoc Tan owned 80% of the shares, Ms. Chau Ngoc Phung and Mr. Tran Quoc Tuan each owned 10%.

In terms of business lines, the main business registered by the enterprise is the production of food and processed foods. Specifically, the production and processing of agricultural products including peanuts, cashews, vegetables, tea, coffee; food processing, fast food, frozen food including pizza, coconut jelly, agar, and drinks extracted from seaweed.

Tan Tan has registered 16 other business lines, including tree planting; processing and preserving fruits and vegetables; producing non-alcoholic beverages and mineral water; trading in food; trading in real estate, land use rights owned by the owner, user or lessee...

Under the leadership of Mr. Tran Quoc Tan, Tan Tan peanut brand quickly developed, becoming a famous, high-revenue enterprise in Vietnam.

After a period of operation, on July 5, 2011, Mr. Tan suddenly withdrew capital from his enterprise. Accordingly, this man transferred to Ms. Nguyen Thi Thanh 3.6 million shares of Tan Tan Company, worth 36.6 billion VND. The enterprise later recorded that Ms. Thanh owned 45.8% of the charter capital.

After becoming a major shareholder, Ms. Thanh repeatedly requested the company's Board of Directors to provide information on business operations, convene extraordinary shareholders' meetings, provide financial reports, and re-elect the Board of Directors. However, the Board of Directors did not comply.

Although she had paid in full for the shares from Mr. Tan, Ms. Thanh had no right to participate in the management or know the business results. On November 19, 2015, Ms. Thanh filed a lawsuit with the People's Court of Binh Duong Province against the Board of Directors of Tan Tan Joint Stock Company.
