Proposal to amend the retirement age regulations in the Law on Teachers

The proposed retirement age for preschool teachers is 5 years earlier than the current regulation. (Illustrative image: Anh Thư.) Over the past period, the Ministry of Education and Training has paid great attention to the teaching staff regarding policies, salary regulations, and especially is finalizing the draft Law on Teachers. The draft Law on Teachers reflects a proactive spirit and always prioritizes the rights and responsibilities of the teaching staff. I have also been very interested in the draft Law on Teachers that the Ministry of Education and Training has put forward for discussion and feedback from a large number of teachers. I have also followed the information and seen that the Government and the National Assembly are paying close attention to these draft laws. However, the Government and National Assembly leaders have also emphasized: "In order for draft laws to be put into practice, and to avoid situations where newly enacted laws have to be amended or supplemented...", ministries and agencies drafting laws need to conduct thorough and comprehensive research, and widely solicit opinions from the people... I would like to offer the following comments on the Draft Law on Teachers: In the second draft of the Law on Teachers, Clause 1, Article 49 stipulates: Preschool teachers and teachers in schools for people with disabilities are entitled to retirement benefits as prescribed; the retirement age of other teachers is implemented according to the provisions of the Labor Code. In the third draft, recently published by the Ministry of Education and Training for public consultation, Clause 1, Article 49 has been amended to: The retirement age of teachers is implemented according to the provisions of the Labor Code; Preschool teachers and teachers in schools for people with disabilities are entitled to retire 5 (five) years earlier than the prescribed retirement age. In my opinion, Clause 1, Article 49 should be amended to: The retirement age of teachers shall be in accordance with the provisions of the Labor Code; preschool teachers may retire 5 (five) years earlier than the prescribed retirement age; teachers in schools for people with disabilities, if they wish to retire early, may retire 5 (five) years earlier than the prescribed retirement age. The reason for this amendment is that there is currently a significant shortage of teachers in schools for people with disabilities; teachers who have worked and been dedicated to the education environment for people with disabilities are very passionate about their profession; these teachers usually teach at the primary, lower secondary, and upper secondary levels. Therefore, to encourage teachers, it should be amended so that teachers in schools for people with disabilities, if they wish to retire early, may retire 5 (five) years earlier than the prescribed retirement age. As for teachers in schools for people with disabilities, if they do not wish to retire early, they will be subject to the provisions of the Labor Code. I completely agree with all other contents in the Draft.
