
The draft Decree detailing certain provisions of the Housing Law comprises 13 chapters and 95 articles, providing detailed regulations on certain provisions of the Housing Law No. 27/2023/QH15 and guiding the implementation of certain articles and clauses of the Housing Law regarding the development and management of social housing, renovation and reconstruction of apartment buildings, inspection, examination, and administrative penalties for violations in the housing sector, as implemented according to other Government Decrees.
At the conference, delegates clarified several remaining issues, such as: clarifying the investment proposal for housing construction projects when applying for investment approval; the conformity of housing construction investment projects with approved planning according to investment law regulations; the investment objectives of the project, the form of capital investment for housing development; the location, scale of the project, and land area allocated for housing construction; clarifying the content of taxes payable according to law, and pre-calculated taxable income in cases where a consulting firm is hired; the conditions for borrowing capital for housing development from credit institutions and financial organizations operating in Vietnam; and the loan conditions according to the law on credit institutions. The loan amount is agreed upon by the parties according to the law on credit.
Based on the opinions of the delegates, Deputy Prime Minister Tran Hong Ha requested the Ministry of Construction to reconsider the principles for classifying apartment buildings, clarifying the purpose of classification. Simultaneously, he suggested researching the classification of commercial and social housing, establishing criteria and evaluation methods issued and published by state agencies (all housing must meet minimum standards and conditions); and referencing criteria from international systems to develop a set of criteria that harmonize with global standards (green, energy-saving, human safety, amenities, sports, health and safety indicators, etc.). Regarding the management and use of apartment buildings, he requested clarification on the organizational structure, operational capabilities, and operating mechanisms required of the building management and operation unit. The Ministry of Construction should include several aspects in the decree, such as the procedures, processes, and the role of the investor.
Deputy Prime Minister Tran Hong Ha requested the Ministry of Construction to incorporate feedback and coordinate with relevant ministries and agencies to urgently finalize the draft for submission to the Government for consideration and decision on promulgation in accordance with legal procedures and regulations.
