New regulations on unemployment insurance from January 1, 2026

From January 1, 2026, a series of new regulations on unemployment insurance policies will have major changes, affecting workers when the 2025 Employment Law comes into effect.

The 2025 Law on Employment was passed by the 15th National Assembly on June 16, 2025, consisting of 8 Chapters and 55 Articles, effective from January 1, 2026. The passing of the 2025 Law on Employment is an extremely important achievement to institutionalize the Party's policies and guidelines on institutional improvement, removing "bottlenecks" of "bottlenecks"; ensuring the synchronization, unity and conformity of the legal system and in accordance with international commitments that Vietnam has participated in, contributing to promoting the development of the labor market, towards ensuring sustainable employment for all workers.

Compared to the 2013 Employment Law, according to Vietnam Social Security, the 2025 Employment Law, which takes effect from January 1, 2026, brings major changes to unemployment insurance policies. In particular, the new regulations focus on unemployment prevention solutions and flexible benefit regimes to better protect the rights of employees and businesses. At the same time, it ensures policy flexibility, especially in cases of economic recession, natural disasters, epidemics, etc.

Expanding the scope of participation

Specifically, in addition to those working under indefinite-term contracts, the 2025 Employment Law stipulates cases that must participate in unemployment insurance, including: workers with fixed-term contracts of 1 month or more; part-time workers whose monthly salary is equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions as prescribed by the Law on Social Insurance.

In addition, salaried management positions include: business managers, controllers, representatives of enterprise capital as prescribed by law; members of the board of directors, general directors, directors, members of the board of supervisors or controllers and other elected management positions of cooperatives and cooperative unions as prescribed by the Law on Cooperatives with salaries.

Increase the maximum unemployment benefit level

Regarding policies, regarding the support regime for workers participating in training and improving their vocational skills, the 2025 Employment Law supplements meal allowance support during the time workers participate in training courses and improve their vocational skills. This new regulation, according to Vietnam Social Security, is to help unemployed people reduce difficulties when participating in vocational training, thereby contributing to increasing the rate of workers participating in vocational training and increasing opportunities to find new, suitable and better jobs.

Regarding unemployment benefits, the new law reduces the waiting time for eligibility for unemployment benefits from 15 working days to 10 working days. Accordingly, the time for employees to receive unemployment benefits is 5 working days earlier than the current regulations (from the 11th working day from the date of submitting complete documents instead of from the 16th working day as currently).

At the same time, the maximum unemployment benefit is increased to 5 times the monthly regional minimum wage (according to the provisions of the 2013 Employment Law, for employees subject to the State-regulated wage regime, the maximum monthly unemployment benefit is not more than 5 times the basic wage). This provision replaces the distinction in the 2013 Law which stipulates a ceiling based on the basic wage for the state sector and the regional minimum wage for the enterprise sector.

Focus on unemployment prevention

In particular, the 2025 Employment Law focuses more on unemployment prevention solutions through supporting businesses. Specifically, the 2025 Employment Law (Article 42) has removed the condition that employers must "not have enough funds to organize training" to be eligible for support.

At the same time, the condition of "Facing difficulties due to economic downturn or other force majeure reasons forcing changes in production and business structure or technology" has been regulated in more detail and specifically such as: Changes in structure, technology or for economic reasons as prescribed in the Labor Code; natural disasters, fires, enemy attacks or dangerous epidemics; implementing decisions of competent state agencies on relocation or reduction of production and business locations...

This regime will contribute to maintaining jobs for workers, thereby helping to stabilize workers' lives, contributing to social stability. At the same time, when workers' jobs are maintained, it will contribute to reducing the number of people receiving unemployment benefits.

In addition, previously during the Covid-19 pandemic, the decision to use the Unemployment Insurance Fund's surplus to provide cash support to employees and support the reduction of unemployment insurance contributions for employers had to be made by the National Assembly and the National Assembly Standing Committee. Now, the 2025 Employment Law assigns the Government to decide. This regulation will facilitate the issuance of support policies faster, promptly resolving the regime for employees and employers to quickly stabilize production and business.
