At the 9th Session, the 15th National Assembly passed the Law amending and supplementing a number of articles of the Law on Advertising, effective from January 1, 2026.
The Law amending and supplementing a number of articles of the Advertising Law was passed with many new contents that not only overcome the shortcomings and limitations of current advertising laws but also thoroughly reform administrative procedures, decentralize and delegate maximum power in the spirit of the 10th Central Conference.
At the same time, supplement regulations on management of online advertising activities to create a transparent, equal and open business environment in the context of economic integration, cultural exchange and the development of science and technology today.
The Advertising Law focuses on three major policies, including: Completing regulations on advertising content and forms in line with the diverse development of advertising activities; completing regulations on the management of advertising activities in the press, online environment and cross-border advertising services; completing regulations on outdoor advertising activities.
Therefore, to ensure consistency and unity in the legal system, it is necessary to develop and promulgate a Decree detailing a number of articles and guiding the implementation of the Law on Advertising, which details the contents of the Law amending and supplementing a number of articles of the Law on Advertising, while inheriting, developing and replacing the contents that are no longer suitable in Decree No. 181/2012/ND-CP and Decree No. 70/2021/ND-CP.
The purpose of drafting the Decree is to institutionalize the Party's guidelines, policies and guidelines on state management of advertising; perfect the legal system to create a legal corridor to improve the effectiveness and efficiency of state management of advertising activities.
The issuance of the Decree detailing a number of articles and providing guidance on the implementation of the Law on Advertising aims to ensure consistency and uniformity in the enforcement between the Law on Advertising, the Law amending and supplementing a number of articles of the Law on Advertising and relevant legal documents, and to avoid legal gaps after the Law is issued.
The Draft Decree consists of 6 chapters and 38 articles, built on the basis of inheriting the relevant provisions of Decree No. 181/2013/ND-CP dated November 14, 2013 of the Government detailing the implementation of a number of articles of the Law on Advertising, and at the same time amending, supplementing and replacing them comprehensively to suit the emerging practices and management requirements in the new context, specifically as follows:
Chapter I: General provisions.
Chapter II: List and requirements for advertising content of special products, goods and services.
Chapter III: Advertising on television; advertising on the Internet; advertising on specialized advertising screens with network connections; advertising national brands on commune-level radio stations.
Chapter IV: Outdoor advertising planning; representative offices of foreign advertising enterprises in Vietnam.
Chapter V: State management responsibilities.
Chapter VI: Implementation provisions.
The Ministry of Culture, Sports and Tourism is seeking public opinion on this draft.
