Do motorcyclists need to turn on their headlights in the rain and at night?

Clause 1, Article 6 of Decree 100/2019/ND-CP stipulates penalties for drivers of motorcycles, mopeds (including electric motorcycles), and similar types of vehicles who violate road traffic rules.

This includes a regulation imposing a fine of 100,000 to 200,000 VND on motorcyclists who do not use headlights between 7 PM the previous day and 5 AM the following day, or when there is fog or bad weather that restricts visibility.

According to the regulations, not using headlights between 7 PM the previous day and 5 AM the following day, or during fog or bad weather that restricts visibility, will result in a fine of 100,000 to 200,000 VND.

Rainy and dark weather is considered bad weather that restricts visibility, and failing to turn on headlights will result in a fine of 100,000 to 200,000 VND. Therefore, motorcyclists must turn on their headlights when traveling on the road in rainy and dark conditions.

Based on point c, clause 10, Article 6 of Decree 100/2019/ND-CP and point c, clause 35, Article 2 of Decree 123/2021/ND-CP, there are regulations on penalties for drivers of motorcycles, mopeds (including electric motorcycles), and similar types of vehicles who violate road traffic rules.

Accordingly, drivers who operate vehicles in the dark or in the rain without turning on their headlights and cause an accident will have their driver's license suspended for 2 to 4 months.

Based on Clause 1, Article 74 of Decree 100/2019/ND-CP, which stipulates the division of authority for administrative sanctions in the field of road and rail transport as follows: " The Chairpersons of People's Committees at all levels have the authority to impose sanctions for violations of the regulations in this Decree within the scope of their local administration ."

According to Clause 1, Article 75 of Decree 100/2019/ND-CP, as amended by Clause 27, Article 2 of Decree 123/2021/ND-CP, which stipulates the authority of the Chairpersons of People's Committees at all levels to impose penalties, the Chairperson of the People's Committee at the district level has the authority to impose fines up to VND 5,000,000 for violations in the field of road and rail transport.

The maximum fine for a motorcyclist driving in the dark or during rain without turning on their headlights is 200,000 VND.
